ive been following this story for awhile there is more to it, i cant wait until they finish it and the public and can find out the rest of the story

The DNA evidence merely shows that he is likely to be a descendant of, or descendant of a close relative of, Lady Hermione Duncombe, later Duchess of Leinster, wife of the 5th Duke. This is similar, but not the same, as proving descent from the 5th Duke. It is descent from the Duke that would indicate right to the Dukedom. Since that cannot be done either by documents, or by DNA in the male line (at that time), his claim must fail, whereas the recognised heir presumptive, Lord John Fitzgerald, merely has to demonstrate descent from the 8th Duke, which he clearly can.
