Liberals Considering Original Intent

Over the last few decades, the powerful impact of Conservatism on jurisprudential reasoning, both in law school publications and in judicial opinions, has caused progressives reluctantly to deal with original intent in Constitutional Law.

Jess Bravin
, in the Wall Street Journal, reports on a fascinating new development, in which some liberals are considering a positive embrace of Constitutional Originalism philosophically.

A progressive originalism would reject the ruling of the Slaughter-Houses Cases of 1873 which limited the impact of the 14th Amendment’s guarantee of the “privileges or immunities” of individual citizens against the states.

The libertarian potential of such a move could be tremendous, and the conflict within the legal community on the left between an inclination to suppress States’ Rights while enhancing individual rights claims on the basis of the post-Civil War Amendments versus their love of regulation and generally enthusiastic embrace of the cult of Statism will be absolutely fascinating to watch unfold.

The Sham Diversity of Today’s Academia

Anthony T. Kronman, Sterling Professor of Law and former Dean of Yale Law School, laments the post-1960s dégringolade of liberal education in America in Against Political Correctness: A Liberal’s Cri du Coeur in this month’s Yale Alumni Magazine.

Today’s defenders of diversity assume that the interpretive judgments of their students will differ according to their race, gender, and ethnicity. But at the same time they expect their students to share a commitment to the values of political liberalism on which the concept of diversity is based. These values may be the fairest and most durable foundation on which to build a political community. I believe they are. A legal and cultural environment marked by the freedoms that political liberalism affords may be the setting in which institutions of higher education are most likely to flourish. I think it is. But when a presumptive commitment to the values of political liberalism begins to constrain the exploration of the personal question of life’s meaning — when the expectation that everyone shares these values comes to place implicit limits on the alternatives that may be considered and how seriously they are to be taken — the enterprise itself loses much of its power and poignancy for the students involved and their teachers lose their authority to lead it.

Whatever fails to accord with the values of political liberalism fits uncomfortably within the range of possibilities that the prevailing conception of diversity permits students to acknowledge as serious contenders in the search for an answer to the first-personal question of what living is for. The political philosophies of Plato and Aristotle, with their easy acceptance of the natural inequality of humans, offend these values at every turn. So, too, does the theological tradition that runs from Augustine to Calvin, with its insistence on church authority and its doctrines of sin and grace. And much of poetry is motivated by an anti-democratic love of beauty and power.

All of these ideas and experiences are suspect from the standpoint of liberal values. None represents the “right” kind of diversity. None is suitable as a basis for political life, and hence — here is the crucial step — none is suitable (respectable, acceptable, honorable) as a basis for personal life either. None, in the end, can perform any useful function other than as an illustration of the confused and intolerant views of those who had the misfortune to be born before the dawning of the light.

Today’s idea of diversity is so limited that one might with justification call it a sham diversity, whose real goal is the promotion of a moral and spiritual uniformity instead. It has no room for the soldier who values honor above equality, the poet who believes that beauty is more important than justice, or the thinker who regards with disinterest or contempt the concerns of political life. The identification of diversity with race and gender has thus brought us back full circle to the moral uniformity with which American higher education began, nearly four centuries ago.

Liberalism as a Species of Madness

Dr. Lyle H. Rossiter, a psychiatrist, diagnoses liberalism as a psychopathology.

The degree of modern liberalism’s irrationality far exceeds any misunderstanding that can be attributed to faulty fact gathering or logical error. Indeed, under careful scrutiny, liberalism’s distortions of the normal ability to reason can only be understood as the product of psychopathology. So extravagant are the patterns of thinking, emoting, behaving and relating that characterize the liberal mind that its relentless protests and demands become understandable only as disorders of the psyche. The modern liberal mind, its distorted perceptions and its destructive agenda are the product of disturbed personalities.

As is the case in all personality disturbance, defects of this type represent serious failures in development processes… Among their consequences are the liberal mind’s relentless efforts to misrepresent human nature and to deny certain indispensable requirements for human relating. In his efforts to construct a grand collectivist utopia—to live what Jacques Barzun has called “the unconditioned life” in which “everybody should be safe and at ease in a hundred ways”—the radical liberal attempts to actualize in the real world an idealized fiction that will mitigate all hardship and heal all wounds. (Barzun 2000). He acts out this fiction, essentially a Marxist morality play, in various theaters of human relatedness, most often on the world’s economic, social and political stages. But the play repeatedly folds. Over the course of the Twentieth Century, the radical liberal’s attempts to create a brave new socialist world have invariably failed. At the dawn of the Twenty-first Century his attempts continue to fail in the stagnant economies, moral decay and social turmoil now widespread in Europe. An increasingly bankrupt welfare society is putting the U.S. on track for the same fate if liberalism is not cured there. Because the liberal agenda’s principles violate the rules of ordered liberty, his most determined efforts to realize its visionary fantasies must inevitably fall short. Yet, despite all the evidence against it, the modern liberal mind believes his agenda is good social science. It is, in fact, bad science fiction. He persists in this agenda despite its madness.

And John Perazzo identifies one of the most seriously afflicted of our contemporaries:

Every so often, a public figure will speak a sentence that succinctly sums up his or her entire worldview in just a few words, exposing the core belief that is the wellspring of his or her every position on matters of consequence. Consider, for instance, Speaker of the House Nancy Pelosi’s recent assertion: “If we [the U.S. military] leave Iraq, then the insurgents will leave Iraq, the terrorists will leave Iraq.”
