Federal Government Pays Housing Incentives to Prisoners

CNBC reports that the homebuyers stimulus program was rife with fraud. How does the administrator approving the payment fail to notice the prison address?

Nearly 1,300 prison inmates wrongly received more than $9 million in tax credits for homebuyers despite being locked up when they claimed they bought a home, a government investigator reported Wednesday.

The investigator said 241 of the inmates were serving life sentences.

In all, more than 14,100 taxpayers wrongly received at least $26.7 million in tax credits that were meant to boost the nation’s slumping housing markets, said the report by J. Russell George, the Treasury Department’s inspector general for tax administration.

Some taxpayers received the credit for homes purchased before the tax break was started. In other cases, multiple taxpayers improperly used the same home to claim multiple credits. Investigators found one home that was used by 67 taxpayers to claim credits.

How the Gulf Oil Spill Undermines the Cult of Statism

Anne Applebaum points out just how ridiculous Obama looks, as he plays King Canute and tries ordering the oil to stop flowing.

Here is the hard truth: The U.S. government does not possess a secret method for capping oil leaks. Even the combined wisdom of the Obama inner circle—all those Harvard economists, silver-tongued spin doctors, and hardened politicos—cannot prevent tens of thousands of tons of oil from pouring out of a hole a mile beneath the ocean’s surface. Other than proximity to the Louisiana coast, this catastrophe therefore has nothing whatsoever in common with Hurricane Katrina. That was an unstoppable natural disaster that turned into a human tragedy thanks to an inadequate government response. This is just an unstoppable disaster, period. It will be a human tragedy precisely because no government response is possible.

Which leads me to mystery: Given that he cannot stop the oil from flowing, why has President Barack Obama decided to act as if he can? And given that he is totally reliant on BP to save the fish and the birds of the Gulf of Mexico, why has he started pretending otherwise—why, in his own words, is he looking for someone’s “ass to kick”? I am guessing that there are many reasons for this recent change of rhetorical tone and that some of them are ideological. Of course, this is a president who believes that government can and should be able to solve all problems. Obama has never sounded particularly enthusiastic about the private sector, and some of his congressional colleagues—the ones talking of retroactively raising the cap on BP’s liability, for example, or forcing BP to pay for the lost wages of other oil company’s workers—are downright hostile.

A large part of the explanation is cultural, however: Obama has been forced to take on a commanding role in a crisis he cannot control because we expect him to—both “we” the media, and “we” the bipartisan public. Whatever their politics, most Americans in recent years have come to expect a strong response—an invasion, a massive congressional bill—from their politicians in times of crisis, and this one is no exception. We want the president to lead—somewhere, anywhere. A few days ago, the New York Times declared that “he and his administration need to do a lot more to show they are on top of this mess,” and should have started “putting the heat” on BP much earlier—as if that would have made the remotest bit of difference. …

Paradoxically, “talking tough” about this oil crisis also makes both Obama and America look weak internationally—just as “talking tough” about Iran made the Bush administration look weak. Harsh rhetoric is fine if it reflects a real will to do something, a real plan of action, and the existence of a Plan B for when the first one fails. But when angry words—anti-BP, anti-British, anti-oil-company—reflect the absence of any alternative policy whatsoever, they just sound pathetic. It’s right for Obama to be concerned about the consequences of this disaster, but wrong—and dangerous—for him to pretend he is capable of controlling it. We should stop calling on him to do so.

Christopher Chantrill points out that conservatives have been too frequently playing along with liberal assumptions in criticizing Obama’s handling of the BP Oil Spill and predicts the myth of the ominpotent state will eventually collapse.

It is true that liberalism is cruel, corrupt, wasteful, and unjust. But one should never forget its delusion. The delusion is a simple one. It is a belief that government can be made rational and efficient. This delusion leads our liberal friends into disaster after disaster.

Liberals were shocked that President Bush failed to get everyone tucked up in bed in a couple of days after Hurricane Katrina. They knew that a rational and efficient government, run by people like them who believed in government, could do better.

Now President Obama is busy proving them wrong.

Unfortunately, conservatives aren’t helping. In pointing out the serious lapses in the president’s leadership qualities, we conservatives are missing the point. We are encouraging liberals in their delusion. Instead, we should remind everyone that of course a bunch of corporate bureaucrats, combined with a bunch of government bureaucrats, are going to be a bit off the mark. …

How does a religion collapse? During the Christianization of northern Europe, the monks would topple the idols of the pagan gods. See, they said, our true God is more powerful than your gods.

Is that how liberalism will come to an end? When the Keynesian idols are finally toppled? Most likely the end will catch everyone by surprise, like the sudden collapse of the Soviet Union.

Press and Public Think Government Has Magical Powers

“Pay no attention to the man behind the curtain!”

Gene Healy describes how our popular cultural habit of demanding intervention by a supposedly omnipotent and omniscient state will produce no real results other than a larger and more powerful state. The government will not, however, develop the desired capabilities of preventing untoward events and effectuating instant solutions.

Did you plug the hole yet, Daddy?” 11-year-old Malia demanded Thursday morning while the president was shaving. Poor President Obama: even his kids won’t give him a break about the Gulf oil spill.

Tough. It’s hard to feel sorry for the “Yes We Can” candidate, who got the job by stoking the juvenile expectation that there’s a presidential solution to everything from natural disasters to spiritual malaise.

But the adults among us ought to worry about a political culture that reacts to every difficulty by screaming “Save us, Superpresident!”

It’s “taking so doggone long,” Sarah Palin wailed, for Obama “to dive in there” (literally?). “Man, you got to get down here and take control!” James Carville screeched. “Tell BP, ‘I’m your daddy!'”

When Hurricane Katrina hit, liberals who had spent years calling President Bush a tyrant suddenly decided he wasn’t authoritarian enough when he hesitated to declare himself generalissimo of New Orleans and muster the troops for a federal War on Hurricanes.

Now the party of “drill, baby, drill” — the folks who warn that Obama’s a socialist — is screaming bloody murder because he’s letting the private sector take the lead in the well-capping operation. It’s almost enough to make a guy cynical about politics.

What do Carville, Palin, et al. want the president to do? “Replace [BP] with what?” asks Coast Guard Adm. Thad Allen, commanding officer at the scene. As the president admitted Thursday, “The federal government does not possess superior technology to BP,” which is trying to clean up its mess with backup from a team of scientists and engineers assembled by the feds.

Should Obama travel back in time and institute better regulation? “He could’ve demanded a plan in anticipation of this,” Carville insists.

Perhaps, but it’s hardly surprising that a president who sits atop a 2-million-employee executive branch, pretending to run it, hasn’t magically solved the problem of bureaucratic incompetence or devised a plan to deal with every conceivable hazard life might present. …

The public’s frustration is understandable. But the unreflective cry “Do something!” usually results in policies that follow the logic immortalized in the BBC comedy “Yes, Minister”: “Something must be done. This is something. Therefore we must do it!”

In Hurricane Katrina’s aftermath, that “something” was legislation (thankfully repealed in 2008) giving the president dangerous new powers to use troops at home to restore order and institute military quarantines during natural disasters or disease outbreaks. …

BP will pay dearly for its apparent negligence, ending up poorer and smaller as a result of the spill. Not so with the federal government: disasters are the health of the state.

That dynamic won’t change as long as pundits, pols and the public embrace the poisonous notion that the president is America’s daddy.

Worshipping Leviathan

My liberal classmates rant and rave regularly about the nefarious behavior of Wall Street banks and big corporations, but in their eyes government can do no wrong (as long as Republicans are not in charge).

Coyote reflects on the strangeness of the statist perspective.

I have total sympathy with those who distrust corporations. Distrust and skepticism are fine things, and are critical foundations to individual responsibility. History proves that market mechanisms tend to weed out bad behaviors, but sometimes these corrections can take time, and in the mean time its good to watch out for oneself.

However, I can’t understand how these same people who distrust the power of large corporations tend to throw all their trust and faith into government. The government tends to have more power (it has police and jails after all, not to mention sovereign immunity), is way larger, and the control mechanisms and incentives that supposedly might check bad behavior in governments seldom work.

A Liberal Proposes a Limit to Government Growth

Talk about man bites dog news items.

Jacob Weisberg, Slate’s editor in chief, is a liberal, but he seems to have miraculously suddenly developed a healthy concern about the growth of government. I don’t believe there is the slightest possibility of Barack Obama or Nancy Pelosi listening to any of this, but Weisberg’s Make It Stop editorial features both a refreshing dash of libertarianism and the kind of common sense which recognizes both consequences and limits and it is just not the kind of thing one normally ever finds being written by a commentator on his side of the debate.

At this point, Obama and the Democrats may be destined to learn the old lesson once again. But if they hope to avoid a repeat of Clinton’s 1994 fate in 2010, the president and his party might think about fixing a long-term upper limit on the size of government. Because of the bank bailouts and stimulus, federal spending will exceed 25 percent of GDP this year, and public spending at all levels will exceed 44 percent. But if liberals were clear that, in normal times, federal spending shouldn’t be more than 22 percent and that the public sector as a whole shouldn’t exceed a third of GDP—the level during Clinton’s second term—the fear of Democrats covertly foisting a social-democratic model on America would begin to melt away. This kind of ceiling would mean that government couldn’t grow at the expense of the economy, because it couldn’t grow faster than the economy as a whole. To substantiate his commitment, Obama should unilaterally propose large, specific cuts in programs and subsidies to be phased in as the need for stimulus spending recedes. Raising the retirement age, privatizing space exploration, and eliminating agriculture subsidies would make a decent start.

Beyond actually endorsing smaller government, Obama could identify himself with wiser government by developing the responsibility theme he sounded in his inaugural address but has returned to infrequently in the period since. Health care reform based on an individual mandate is a good example of government linking a private duty to a public benefit, but Obama hasn’t emphasized this “values” aspect of the plan. Another example might be to require public service work in exchange for extended unemployment benefits, on the principle of welfare reform. A nicotine-addicted president should also steer clear of paternalistic, class-tinged policies like taxing soft drinks. Letting personal behavior that doesn’t harm others slide means recognizing another kind of limit on government.

There’s a risk of harming the country by failing to address fundamental threats and problems—which is where current Republican policies would leave us. There’s also a risk of Democrats responding in a way that leaves behind more government than we want or need. Obama could help himself by letting people know he’s worried about that danger too.

I think most Republicans really would be fairly content, if an adequate portion of the federal budget remained reliably devoted to defense expenditures, to let the liberals have the equivalent of a spousal allowance, all the rest of the federal budget beyond defense to spend on the charitable, artistic, or environmental good works of their choice, as long as overall federal spending was not consuming so large a portion of the national economy as to curtail growth. But, would a liberal upper limit to government growth and spending ever be conceded by the American left? I have a lot of trouble picturing that.

The left would have to abandon its imperialistic drive toward limitless expansion of the state. It would have to relinquish its favorite tactic of demonizing its political opponents as selfish and greedy and its habit of identifying this year’s chosen socialist scheme as an absolute moral imperative. It would have to, at some point, stop demanding more and try to decide on reallocating what it already has, which seems far, far too difficult to ever happen.

Still, reading Weisberg today brings to mind a pleasant fantasy of a less divisive American political culture, one missing our own’s customary shrieks of hysterical accusation, one featuring occasional bipartisanship and overall rationality. That isn’t the world we live in, but it would be nice.

Unionized Government Workers, the New Ruling Class

Stanley Greenhut, in the February issue of Reason, explains how the increasing political power of unionized government employees is producing larger government along with luxurious compensation for a new Mandarinate able to tax the rest of us.

Public-sector unions have a growing influence in state and federal governments, and in the overall labor movement, but they are a relatively recent phenomenon. Civil service unionization in the federal government wasn’t allowed until President John F. Kennedy issued an executive order legalizing it in 1962. In California it didn’t become legal until 1968. Yet now California may be spearheading the re-unionization of the country. …

At all levels, state and local government employment grew by 13 percent across the United States from 1994 to 2004. The number of judicial and legal employees increased by 28 percent. The number of public safety workers increased by 21 percent. The number of teachers increased by 22 percent. …

The United States had 2.3 state and local government employees per 100 citizens in 1946 and has 6.5 state and local government employees per 100 citizens now. In 1947, Hodges writes, 78 percent of the national income went to the private sector, 16 percent to the federal sector, and 6 percent to the state and local government sector. Now 54 percent of the economy is private, 28 percent goes to the feds, and 18 percent goes to state and local governments. The trend lines are ominous. …

Bigger government means more government employees. Those employees then become a permanent lobby for continual government growth. The nation may have reached critical mass; the number of government employees at every level may have gotten so high that it is politically impossible to roll back the bureaucracy, rein in the costs, and restore lost freedoms.

People who are supposed to serve the public have become a privileged elite that exploits political power for financial gain and special perks. Because of its political power, this interest group has rigged the game so there are few meaningful checks on its demands. Government employees now receive far higher pay, benefits, and pensions than the vast majority of Americans working in the private sector. Even when they are incompetent or abusive, they can be fired only after a long process and only for the most grievous offenses.

It’s a two-tier system in which the rulers are making steady gains at the expense of the ruled. The predictable results: Higher taxes, eroded public services, unsustainable levels of debt, and massive roadblocks to reforming even the poorest performing agencies and school systems. If this system is left to grow unchecked, we will end up with a pale imitation of the free society envisioned by the Founders.

US Government Employment Exceeds US Manufacturing Employment

Ouch! Business Insider reprints an illustrative graph from Seeking Alpha marking the progress of American decline.

In the just-so story of the evolution of our economy, our old manufacturing based economy has been replaced by an innovative knowledge economy. That’s not quite true.

In fact, the decline of the jobs in goods producing sectors of the economy–construction, manufacturing, mining and agriculture–has largely been met with an increase in jobs on the government payroll. We’ve gone from providing jobs in profit-making private industry to providing jobs in profit-eating government work. Toward the end of 2007, the total number of government jobs exceeded the total number of goods producing jobs. Welcome to the government payroll economy.

“A Nation Fully Settled By Government”

Peggy Noonan contends that the Progressive Frontier of government expansion closed some time ago. Americans already have all the government, all the services, taxes, and regulations they can stand. Barack Obama and the democrats in Congress are yearning to go back to a Depression era past in which paternalistic leaders in Washington taxed and spent, and delivered de haute en bas charitable goodies to grateful voters. Americans today know that they will have to pay for any gifts sent to them from Washington themselves.

I’m not sure the White House can tell the difference between campaign mode and governing mode, but it is the difference between “us versus them” and “us.” People sense the president does too much of the former, and this is reflected not only in words but decisions, such as the pursuit of a health-care agenda that was inevitably divisive. It has lost the public’s enthusiastic backing, if it ever had it, but is gaining on Capitol Hill. People don’t want whatever it is they’re about to get, and they’re about to get it. In that atmosphere everything grates, but most especially us-versus-them-ism.

The biggest thing supporters of a health care overhaul do not understand about those who oppose their efforts, and who oppose the Baucus bill, which has triumphantly passed the Senate Finance Committee even though no one knows exactly what is or will end up in it, is the issue of context.

The Democratic Party and the White House repeatedly suggest that if you are not for the bill or an overhaul, you don’t care about your fellow human beings and you love and support the insurance companies. Actually, no one loves the insurance companies, including the insurance companies. … But the Obama administration’s strategy of making (the insurance industry) “the villain” in “the narrative” will probably not have that much punch because . . . well, again, who likes the insurance companies? Who ever did?

People who oppose a health-care overhaul are not in love with insurance companies. They’re not even in love with the status quo. Everyone knows the jerry-built system of the past half-century has weak points. They just don’t think the current plan will shore them up. They think the plan would create new weak points and widen old ones. They think this because they have brains.

But even that doesn’t get to the real subtext of the opposition. Yes, the timing is wrong—we have other, more urgent crises to face, and an exploding deficit. And yes, a big change in a huge economic sector during economic crisis is looking for trouble.

But a big part of opposition to the health-care plan is a sense of historical context. People actually have a sense of the history they’re living in and the history their country has recently lived through. They understand the moment we’re in.

In the days of the New Deal, in the 1930s, government growth was virgin territory. It was like pushing west through a continent that seemed new and empty. There was plenty of room to move. The federal government was still small and relatively lean, the income tax was still new. America pushed on, creating what it created: federal programs, departments and initiatives, Social Security. In the mid-1960s, with the Great Society, more or less the same thing. Government hadn’t claimed new territory in a generation, and it pushed on—creating Medicare, Medicaid, new domestic programs of all kinds, the expansion of welfare and the safety net.

Now the national terrain is thick with federal programs, and with state, county, city and town entities and programs, from coast to coast. It’s not virgin territory anymore, it’s crowded. We are a nation fully settled by government. We are well into the age of the welfare state, the age of government. We know its weight, heft and demands, know its costs both in terms of money and autonomy, even as we know it has made many of our lives more secure, and helped many to feel encouragement.

But we know the price now. This is the historical context. The White House often seems disappointed that the big center, the voters in the middle of the spectrum, aren’t all that excited about following them on their bold new journey. But it’s a world America has been to. It isn’t new to us. And we don’t have too many illusions about it.

Why Skepticism About Obamacare?

The Barrister explains to our liberal friends why so many Americans are reluctant to believe a Government-run health system would be better.

I do not think it’s so much because people want freedom and choice (altho they do) as it is because people have no confidence in government entitlement programs (which the Dem plans are all about, ultimately). Why?

Social Security – bankrupt
Postal Service – bankrupt
Welfare – had devastating unintended consequences for which the nation still pays and from which the nation continues to suffer (eg huge rates – up to 70% – of single motherhood among beneficiaries)
Medicare – bankrupt
Medicaid – bankrupting the states
Government-run (ie union-controlled) schools: are people thrilled with them?
Fannie Mae and Freddy Mac – bankrupt
The “stimulus” – a failure, but it did create 25,000 new government jobs!

The future tax consequences of the above are daunting to people, and the idea of adding another trillion or so frightens the heck out of people who are thinking about their own well-being, their kids’ futures – and also about the nation’s. …

Abundant, high quality, and fairly expensive medical care is one of the great blessings and privileges of a prosperous society, and thus an important economic engine. Why kill it? People want these things.

Do Americans want to be grown-ups, or children? It’s our call.

My liberal classmates, I find, are simply members of a religious cult whose object of worship is the state. Everything enlarging state income, power, and authority is good. Anything you want done, just turn it over to the federal government.

The government is to them rather the the genie in the lamp. Want poverty eliminated? Want free health care for everyone? Want a perfect world? Just rub the lamp, let those democrats pass an appropriations bill, and voilà! your friendly government genie grants your wish.

They actually believe that the same government that buys $435 hammers, $640 toilet seats, and $7600 coffee makers, the same government whose lawmakers can neither read the healthcare bill they’re voting on or arrange to have it put on-line, is going to streamline delivery and make health care cheaper and more efficient. Pure insanity.

Blaming the Market

Coyote identifies precisely what’s going on with “Health Care Reform.”

The leftish political strategy for over 100 years has been

1. Regulate something

2. Blame the free market for inevitable disruptions caused by the regulation

3. Use the above to justify more regulation

4. Repeat

We have an artificial situation, created by government tax policy in the first place. Healthcare charges have been removed from market influence because the consumer has not been paying them, his insurance has. The consumer normally does not buy his own insurance. Tax policy has arranged for health insurance to be a benefit of corporate employment.

When you do get to buy your own health insurance is when you lose your job, and then, ouch! you tend to find out just how expensive being a member of a maginal, ill-serviced market can be, at the very time you can least afford it.

Reforming health care simply requires transferring the tax deduction to individuals, reducing the burden of litigation and consequent staggering malpractice insurance costs and defensive medicine, and removing state barriers to insurance competition. Democrats don’t like any of that. When Whole Foods’ John Mackey made several of these suggestions in the Wall Street Journal editorial, his company was subjected to a boycott.

Not just anyone should be allowed to take his mouse and ride the Information Superhighway anonymously, argues an Australian authority on crime.

Australia’s leading criminologist thinks online scams have escalated to such a point that first-time users of computers should have to earn a licence to surf the web.

Russel Smith, principal criminologist at the Australian Institute of Criminology said the concept of a “computer drivers licence” should be taken seriously as an option for combating internet-related crime.

“There’s been some discussion in Europe about the use of what’s called a computer drivers licence – where you have a standard set of skills people should learn before they start using computers,” Dr Smith told iTnews.

“At the moment we have drivers licences for cars, and cars are very dangerous machines. Computers are also quite dangerous in the way that they can make people vulnerable to fraud.

“In the future we might want to think about whether it’s necessary there be some sort of compulsory education of people before they start using computers,” he said.

How to Expand Federal Power

Let me place myself in the President’s chair, at the head of a party in this country, aiming to extend the influence of the governing powers at the expence of the governed; to increase the authority and prerogative of the Executive, and to reduce by degrees to a mere name, the influences of the people. How should I set about it? What system should I pursue?

As the rights reserved by the State Governments and the bounds and limits set by the Constitution of the Union, are the declared barriers against the encroachments of entrusted power, my first business would be to undermine that Constitution, and render it useless, by claiming authority which, though not given by the express words of it, might be edged in under the cover of general expressions or implied powers — by stretching the meaning of the words used to their utmost latitude, — by taking advantage of every ambiguity — and by quibbling upon distinctions to explain away the plain and obvious meaning. It would be my business to extend the powers of the Federal Courts and of Federal Officers — to encroach upon the State jurisdictions — to throw obloquy on the State Governments as clogs upon the wheel of the General Government — for that purpose to promote a spirit of party among them, and subject to accusations of disaffection those who were opposed to the measures I would pursue. In addition to this I would now and then exercise trifling acts of authority not granted by the Constitution, under some undefined notion of prerogative. If by such means one encroachment should be made good, it would be a precedent for another, until the public by degrees would become accustomed and callous to them.
