Jack Cashill has two possible suggestions.

In the recent military tribunal hearing on his combatant status, Khalid Sheikh Muhammad owned up to 29 separate acts of terror in which he served, at the very least, as “responsible participant.” Some such acts, September 11 for instance, he claimed to have successfully masterminded and executed.

Others he helped plan but, happily, did not manage to pull off. These include schemes to destroy the Sears Tower in Chicago, the New York Stock Exchange and the Panama Canal as well as plots to assassinate Pope John Paul II and presidents Clinton and Carter.

It is likely that KSM has inflated his role in many of these events, but just as likely that he was at least involved.

The Department of Defense does not edit a word out of 28 of the 29 acts that KSM listed. But one act, number 3 in KSM’s line-up, the DOD originally redacted entirely.

The numerical placement seems critical here. In number 1, KSM assumes responsibility for the “1993 World Trade Center Operation,” and there is no reason to doubt him.

In number 2, he takes credit for “the 9/11 Operation, from A to Z.” Although KSM overstates his control of the operation, there is little reason to question his involvement.

In number 4, KSM admits his participation in the “Shoe Bomber operation to down two American airplanes.” Again, this seems like a credible claim.

Number 3, however, was originally posted as “REDACTED.” This was before the Internet started humming about its likely contents.

Given the placement of number 3 high among the provable acts of terror committed against Americans on American soil, I and others speculated that KSM may very well have been staking claim to one of two events.

One is the Oklahoma City bombing. As has been well enough documented, convicted conspirator Terry Nichols made multiple trips to the Philippines when KSM’s “nephew,” Ramzi Yousef, was living there. Yousef was constructing the bombs for the impending aviation attack that KSM refers to as “the Bojinka operation.”

According to a recent House report, Nichols traveled with the book, ”The Chemistry of Powder and Explosives,” and just happened to show up in Cebu City at the exact same time as master bomber Yousef.

This was November 1994, six months before the Oklahoma City bombing. Nichols changed his itinerary immediately after Yousef’s lab was busted by the Manila police in January 1995 and left the county in haste.

In “Against All Enemies,” Clinton anti-terror czar Richard Clarke has this to say about the visits of these two terrorists to the same city in the same country at the same time: “We do know that Nichols’ bombs did not work before his Philippine stay,” writes Clarke, “and were deadly when he returned.”

The second likely suspect for the redacted terror act was TWA Flight 800, the 747 blown out of the sky off the coast of Long Island on July 17, 1996, Saddam’s national liberation day.

According to two separate sources within the NSA, on the night the plane went down Yousef phoned KSM from his New York City prison and said—in their native Baluchi– “What had to be done has been done, TWA 800” (last two words unintelligible).”

The next day Yousef asked for a mistrial, arguing in high chutzpah that the environment had turned prejudicial in regard to accused airplane bombers like himself.

Cashill does seem right that the order of the redacted item makes it look like a very important terrorist act. I had wondered if it might have been referring to TWA Flight 800 myself, having read lots of speculation on the Net that Sandy Berger’s efforts at removing Clinton Administration documents from the National Archives may have been occasioned by the necessity to remove Flight 800 references. It’s certainly a good conspiracy theory.

KSM tells a story exculpating some Guantanamo detainees, which could conceivably be true.

I’m asking you to be fair with Afghanis and Pakistanis and many Arabs which been in Afghanistan. Many of them been unjustly. The funny story they been Sunni government they sent some spies to assassinate UBL then we arrested them sent them to Afghanistan/Taliban. Taliban put them into prison. Americans they came and arrest them as enemy combatant. They brought them here. So, even if they are my enemy but not fair to be there with me.

For this verse, I not take the oath. Take an oath is a part of your Tribunal and I’ll not accept it. To be or accept the Tribunal as to be, I’ll accept it. That I’m accepting American constitution, American law or whatever you are doing here. This is why religiously I cannot accept anything you do. Just to explain for this one, does not mean I’m not saying that I’m lying. When I not take oath does not mean I’m lying. You know very well peoples take oath and they will lie. You know the President he did this before he just makes his oath and he lied. So sometimes when I’m not making oath does not mean I’m lying.

What I wrote here, is not I’m making myself hero, when I said I was responsible for this or that. But your are military man. You know very well there are language for any war. The leader of the al-Qaida-affiliated Islamic State of Iraq has been captured in a raid west of Baghdad, an Iraqi military spokesman said Friday.

Abu Omar al-Baghdadi was captured Friday in a raid in Abu Ghraib on the western outskirts of Baghdad, said Brig. Gen. Qassim al-Moussawi, spokesman of the Baghdad security operation. U.S. officials had no confirmation of the capture.

“One of the terrorists who was arrested with him confessed that the one in our hands is al-Baghdadi,” al-Moussawi said.

Al-Baghdadi has been identified in statements posted on Islamic extremist Web sites as the head of the Islamic State, which was proclaimed last year after the death of the leader of al-Qaida in Iraq, Abu Musab al-Zarqawi.

Al-Baghdadi was said to have headed the Mujahedeen Shura Council, an alliance of al-Qaida and other jihadist organizations, which was set up last year to downplay the role of foreigners in the Iraqi insurgency.

A more recent report from Iraqi authorities denies that the captured individual is A-Baghdadi, but asserts that he is “a senior Al Qaeda leader.”

Debra Burlingame, at the Wall Street Journal, explains how Kuwaiti oil money successfully transformed Guantanamo Bay detainees from bloodthirsty killers into a human rights worthy cause.

He was the first American to die in what some have called “the real war.” Johnny “Mike” Spann, the 32-year-old CIA paramilitary commando, was interrogating prisoners in an open courtyard at the Qala-I-Jangi fortress in Afghanistan when the uprising of 538 hard-core Taliban and al Qaeda fighters began. Spann emptied his rifle, then his sidearm, then fought hand-to-hand as he was swarmed by raging prisoners screaming “Allahu akbar!”

The bloody siege by Northern Alliance and U.S. forces went on for several days, only ending when 86 of the remaining jihadi fighters were smoked out of a basement where they had retreated and where they murdered a Red Cross worker who had gone in to check on their condition. Spann, a former Marine, is credited with saving the lives of countless Alliance fighters and Afghan civilians by standing and firing as they ran for cover. His beaten and booby-trapped body was recovered with two bullet wounds in his head, the angle of trajectory suggesting he had been shot execution style.

One of the committed jihadis who came out of that basement, wounded and unrepentant, was “American Taliban” John Walker Lindh, now serving a 20-year sentence in a federal prison. Another who was shot during the uprising and pulled out of the basement along with Lindh was Nasser Nijer Naser al-Mutairi. Today, the 29-year-old is living somewhere in Kuwait, a free man.

The true story of Mr. Mutairi’s journey, from the uprising in Qala-I-Jangi to Guantanamo Bay’s military detention camp to the privileged life of an affluent Kuwaiti citizen, is one that his team of high-priced lawyers and the government of Kuwait doesn’t want you to know. His case reveals a disturbing counterpoint to the false narrative advanced by Gitmo lawyers and human-rights groups–which holds that the Guantanamo Bay detainees are innocent victims of circumstance, swept up in the angry, anti-Muslim fervor that followed the attacks of September 11, then abused and brutally tortured at the hands of the U.S. military.

Mr. Mutairi was among 12 Kuwaitis picked up in Afghanistan and detained at Guantanamo Bay in 2002. Their families retained Tom Wilner and the prestigious law firm of Shearman & Sterling early that same year. Arguably, it is Mr. Wilner’s aggressive representation, along with the determined efforts of the Kuwait government, that has had the greatest influence in the outcome of all the enemy combatant cases, in the court of law and in the court of public opinion. The lawsuit filed on their behalf, renamed Rasul v. Bush when three cases were joined, is credited with opening the door for the blizzard of litigation that followed…

Mr. Wilner, a media-savvy lawyer who immediately realized that the detainee cases posed a tremendous PR challenge in the wake of September 11, hired high-stakes media guru Richard Levick to change public perception about the Kuwaiti 12. Mr. Levick, a former attorney whose Washington, D.C.-based “crisis PR” firm has carved out a niche in litigation-related issues, has represented clients as varied as Rosie O’Donnell, Napster, and the Roman Catholic Church. Mr. Levick’s firm is also registered under FARA as an agent of a foreign principal for the “Kuwaiti Detainees Committee,” reporting $774,000 in fees in a one year period. After the U.S. Supreme Court heard the first consolidated case, the PR campaign went into high gear, Mr. Levick wrote, to “turn the Guantanamo tide.”

In numerous published articles and interviews, Mr. Levick has laid out the essence of the entire Kuwaiti PR campaign. The strategy sought to accomplish two things: put a sympathetic “human face” on the detainees and convince the public that it had a stake in their plight. In other words, the militant Islamists who traveled to Afghanistan to become a part of al Qaeda’s jihad on America had to be reinvented as innocent charity workers swept up in the war after 9/11. The committed Islamist who admitted firing an AK-47 in a Taliban training camp became a “teacher on vacation” who went to Afghanistan in 2001 “to help refugees.” The member of an Islamist street gang who opened three al-Wafa offices with Suliman Abu Ghaith (Osama Bin Laden’s chief spokesman) to raise al Qaeda funds became a charity worker whose eight children were left destitute in his absence. All 12 Kuwaitis became the innocent victims of “bounty hunters.”..

Mr. Levick maintains that a year and a half after they began the campaign, their PR outreach produced literally thousands of news placements and that, eventually, a majority of the top 100 newspapers were editorializing on the detainees’ behalf. Convinced that judges can be influenced by aggressive PR campaigns, Mr. Levick points to rulings in the detainee cases which openly cite news stories that resulted from his team’s media outreach.

The Kuwaiti 12 case is a primer on the anatomy of a guerilla PR offensive, packaged and sold to the public as a fight for the “rule of law” and “America’s core principles.” Begin with flimsy information, generate stories that are spun from uncorroborated double or triple hearsay uttered by interested parties that are hard to confirm from halfway around the world. Feed the phonied-up stories to friendly media who write credulous reports and emotional human interest features, post them on a Web site where they will then be read and used as sources by other lazy (or busy) media from all over the world. In short, create one giant echo chamber.

Dinesh D’Souza thinks it was the result of the Clinton Administration’s cowardice and passivity.

More than five years after 9/11, the crucial question of why the Islamic radicals decided to strike America remains unanswered. Recall that for at least two decades prior to 9/11, radical Muslims were focused on fighting in their own countries. They were trying to overthrow their local governments and to establish Islamic states under sharia law. America was not their target.

Then, in the mid-to-late 1990s, two of the leading Muslim radicals, Ayman al-Zawahiri and Osama Bin Laden, decided on a new strategy. They abandoned the tactic of fighting the “near enemy” and decided to take the battle to the “far enemy,” specifically the United States. If Zawahiri and Bin Laden had not changed course, 9/11 would not have happened.

Why, then, did they do so? In his book the Far Enemy, political scientist Fawaz Gerges argues that the radical Muslims’ strategy of fighting the near enemy proved unsuccessful, and so they decided to try something else. “When jihadis met their Waterloo on home-front battles,” Gerges writes, they “turned their guns against the West in an effort to stop the revolutionary ship from sinking.” This may be correct as far as it goes, but it does not go very far. Gerges fails to explain why Muslim radicals like Zawahiri and Bin Laden, who apparently could not defeat their local governments, came to the conclusion that they could defeat the vastly more formidable United States.

Bin Laden himself supplies the answer to this question. He says he developed the suspicion that despite its outward show of power and affluence, the far enemy was weaker and more vulnerable than the near enemy…

During the mid to late 1990s, the radical Muslims tested America’s resolve by launching a series of attacks on American targets. These were massive attacks, unprecedented in the damage they inflicted. There was the Khobar Towers attack on American facilities in Saudi Arabia, the bombing of U.S. embassies in East Africa, the suicide assault on the American warship the U.S.S. Cole.

Yet in every case the Clinton administration reacted either by doing nothing, or with desultory counterattacks like a missile strike against largely unoccupied Afghan tents and the bombing of what was reported to be a pharmaceutical factory in the Sudan. Clearly these responses inflicted little harm to Al Qaeda and actually made America look ridiculous in the eyes of the Muslim world. Consequently, Bin Laden became convinced that his theory of American irresolution and weakness was substantially correct. By his own account he became emboldened to conceive of a grander and more devastating strike on American shores, the strike that occurred on 9/11.

Even so, this strike could have been prevented had the Clinton administration acted on intelligence leads and struck back at Bin Laden, when it had the chance. Former CIA agent Michael Scheuer estimates that during the second term of the Clinton administration America had approximately 10 opportunities to kill Bin Laden, and took none of them…

The conclusion seems unavoidable. The Islamic radicals made the decision to attack America on 9/11 because they decided that America was cowardly and weak. They came to this conclusion largely as a result of the actions—and inaction—of the Clinton administration and its allies on the left. What could have been done to get rid of Bin Laden and avert 9/11 was not done. In this sense liberal foreign policy gave radical Muslims the confidence and the opportunity to strike, and they did.

Quick! Better elect Hillary Clinton, who’s a lot more leftwing than Bill.

Ronald A. Cass, Chairman of the Center for the Rule of Law and Dean Emeritus of Boston University School of Law, explains why the press has a responsibility to get to the bottom of Sandy Berger’s thefts from the National Archives.

Mr. Berger’s willingness to risk everything to suppress the information goes well beyond ordinary concerns against excessive disclosure.

Bill Clinton obviously has great sensitivity to his place in history and to accusations that he did too little to respond to al-Qaeda, that he is to some degree responsible for failing to prevent 9/11’s tragedy. That is why he and his lieutenants made reckless and baseless accusations against the current Bush administration, attempting to portray them as having dropped the baton handed off by ever-vigilant Clintonistas (who, according to John Ashcroft’s testimony, withheld the MAAAR and its warnings about al-Qaeda’s operations in the US from the Bush transition team).

But maybe there is more to the story. Maybe there is something far worse than we can imagine that is worth having his chief security aide risk his reputation, his career, and his liberty to cover up…

Clinton’s excessive reaction – complete with hyperbole, finger-wagging, and scolding – to a simple question from Fox News’ Chris Wallace about his response to al-Qaeda is in the same vein. Something here touches a nerve.

That nerve is exposed in the Sandy Berger saga. This story at bottom is about the security of our nation, about what was – or was not – done to protect us from the most shocking and deadly attack on American citizens by foreign agents in our nation’s history. This story is critical not only to understanding our past but also to securing our future. It can help us understand what it is reasonable to expect can be done to keep us and our loved ones safe from harm. It is, in short, as important a story as there is.

It is a story the news media should be desperate to explore, not desperate to avoid.

The latest report is that the US airstrike missed “three top al-Qaeda leaders” hiding in Somalia.

And apparently, when we do catch them, we’re still playing catch-and-release. It sounds like it was Hassan Abassi that Condeleezza Rice ordered released.

American officials say the Iranian Revolutionary Guard Quds Force is active in Iraq. A senior military official said last week that one of the Iranians seized in Baghdad late last month was the No. 3 Quds official. He said American forces uncovered maps of neighborhoods in Baghdad in which Sunnis could be evicted, and evidence of involvement in the war during the summer in Lebanon.

That Iranian official was ordered released, by Ms. Rice among others, after Iran claimed he had diplomatic status.

A senior al-Qaida suspect wanted for bombing American embassies in East Africa was killed in a U.S. airstrike, a Somali official said Wednesday, a report that if true would mean the end of an eight-year hunt for a top target of Washington’s war on terror.

There was no immediate confirmation from the U.S. In Washington, a U.S. intelligence official said the U.S. killed five to 10 people in an attack on an al-Qaida target in southern Somalia but did not say who was killed. The official, who spoke on condition of anonymity because of the operation’s sensitivity, said a small number of others present, perhaps four or five, were wounded.

The report came as U.S forces apparently launched a third day of airstrikes in southern Somalia. Witnesses said an AC-130 gunship attacked a suspected al-Qaida training camp. At least four separate strikes were reported Wednesday around Ras Kamboni, on the Somali coast and a few miles from the Kenyan border.

Also Wednesday, Somalia’s Deputy Prime Minister said American troops were needed on the ground to root extremists from his troubled country, and he expected the troops soon. It was the first indication that the U.S. military may expand its campaign.

Fazul Abdullah Mohammed, who allegedly planned the 1998 bombings of two U.S. embassies in East Africa, was killed in a U.S. airstrike early Monday morning local time, according to an American intelligence report passed on to the Somali authorities.

“I have received a report from the American side chronicling the targets and list of damage,” Abdirizak Hassan, the Somali president’s chief of staff, told The Associated Press. “One of the items they were claiming was that Fazul Abdullah Mohammed is dead.”

If confirmed Mohammed’s death would be a major victory for the U.S. in its hunt for the 1998 embassy bombers. The strike was part of the first U.S. offensive in the African country since 18 American soldiers were killed there in 1993.

Ayman al-Zawahiri, in his latest taped address, takes credit for the results of the November election.

Yesterday’s Wall Street Journal featured a lead story about the Bush Administration’s failure to convict Omar Ahmed Khadr, a Toronto-born jihadi captured as an illegal combatant in Afghanistan in July of 2002, after he had thrown a grenade which fatally wounded Sgt. First Class Christopher Speer, a US medic.

Efforts to bring Mr. Khadr to trial via one of the Bush Administration’s controversial military tribunals has been dogged by litigation, and the prosecution has found it impossible to get intelligence agencies to open their secret files or to obtain testimony from the eyewitnesses, military personnel who are inaccessible because they’re serving during wartime at remote locations around the world.

The frustrated Army prosecutor Major Groharing nonetheless defended this preposterous and futile enterprize, arguing:

The difference between us and al Qaeda is that when we had him on the battlefield, we didn’t summarily execute him.

The Bush administration, and Major Groharing, are both crazy.

The attempt to deal, in peacetime and civilian fashion, via legal trials with attorneys, witnesses, and appeals to higher levels of the judiciary, is simply incompatible with the exigencies of war.

Mr. Khadr was an illegal combatant, bearing arms against the military forces of the United States. He violated the customs and usages of war by attacking a medic. He was never entitled to quarter. He should not have been made prisoner. He should not have received medical attention. He should merely have been summarily executed on the spot at the time.

Our cause being just, our conformity to the customs and usages of war, our not firing on medics are all quite sufficient to distinguish us from al Qaeda.”
