Marc Thiessen factually refuted the claim that enhanced interrogations were ineffective back in April of 2009 using government memos revealing that Downtown LA is still there only because KSM talked after being waterboarded.
The Justice Department memo of May 30, 2005… notes that “the CIA believes ‘the intelligence acquired from these interrogations has been a key reason why al Qaeda has failed to launch a spectacular attack in the West since 11 September 2001.’ . . . In particular, the CIA believes that it would have been unable to obtain critical information from numerous detainees, including [Khalid Sheik Mohammed] and Abu Zubaydah, without these enhanced techniques.” The memo continues: “Before the CIA used enhanced techniques . . . KSM resisted giving any answers to questions about future attacks, simply noting, ‘Soon you will find out.’ ” Once the techniques were applied, “interrogations have led to specific, actionable intelligence, as well as a general increase in the amount of intelligence regarding al Qaeda and its affiliates.”
Specifically, interrogation with enhanced techniques “led to the discovery of a KSM plot, the ‘Second Wave,’ ‘to use East Asian operatives to crash a hijacked airliner into’ a building in Los Angeles.” KSM later acknowledged before a military commission at Guantanamo Bay that the target was the Library Tower, the tallest building on the West Coast. …
[And] there is more information confirming the program’s effectiveness. The Office of Legal Counsel memo states “we discuss only a small fraction of the important intelligence CIA interrogators have obtained from KSM” and notes that “intelligence derived from CIA detainees has resulted in more than 6,000 intelligence reports and, in 2004, accounted for approximately half of the [Counterterrorism Center’s] reporting on al Qaeda.” The memos refer to other classified documents — including an “Effectiveness Memo” and an “IG Report,” which explain how “the use of enhanced techniques in the interrogations of KSM, Zubaydah and others . . . has yielded critical information.” Why didn’t Obama officials release this information as well? Because they know that if the public could see the details of the techniques side by side with evidence that the program saved American lives, the vast majority would support continuing it.
Critics claim that enhanced techniques do not produce good intelligence because people will say anything to get the techniques to stop. But the memos note that, “as Abu Zubaydah himself explained with respect to enhanced techniques, ‘brothers who are captured and interrogated are permitted by Allah to provide information when they believe they have reached the limit of their ability to withhold it in the face of psychological and physical hardship.” In other words, the terrorists are called by their faith to resist as far as they can — and once they have done so, they are free to tell everything they know. This is because of their belief that “Islam will ultimately dominate the world and that this victory is inevitable.” The job of the interrogator is to safely help the terrorist do his duty to Allah, so he then feels liberated to speak freely.
San Diego assistant port director Al Hallor, also a U.S. Customs and Border Protection officer, told local ABC affiliate Channel 10 News that authorities have uncovered “weapons of mass effect” in an interview that aired Feb. 11.
Hallor did not say where WMD had been located. He only denied that they had not been found at the port of San Diego. Hallor also did not identify the type of WMD he was referring to, but that reply strongly suggested that he was aware of the apprehension on US soil of at least one nuclear device or the components for a dirty bomb.
“At the airport, seaport, at our port of entry we have not this past fiscal year, but our partner agencies have found those things,” he said.
Reporter: Do you ever find things that are dangerous like a chemical agent or a weaponised device?

Reporter: So, specifically, you’re looking for the dirty bomb? You’re looking for the nuclear device?
Mr Hallor: Correct. Weapons of mass effect.

Reporter: But they have found them?
Mr Hallor: Yes.
Reporter: You never found one in San Diego though?
Mr Hallor: I would say at at the port of San Diego we have not.
A leak by US Intelligence Officials to Some News Agency reveals that in 2008 three of the subway bomb plotters traveled to Pakistan’s Northwest Frontier tribal areas where one of them, possibly all three, met with Adnan el Shukrijumah, the prominent al Qaeda figure known to have been the leader of the failed “Second Wave” attack following 9/11 involving the detonation of a dirty bomb in a major US city, whose target is generally believed to have been Los Angeles.
Shukrijumah was long suspected to have been operating from somewhere in Latin America, but this evidence places him in Waziristan in 2008.
U.S. counterterrorism officials have linked one of the nation’s most wanted terrorists to last year’s thwarted plot to bomb the New York City subway system, authorities said Wednesday.
Current and former counterterrorism officials said top al-Qaida operative Adnan Shukrijumah met with one of the would-be suicide bombers in a plot that Attorney General Eric Holder called one of the most dangerous since the 9/11 terror attacks.
Federal prosecutors in Brooklyn have named Shukrijumah in a draft terrorism indictment but on Wednesday the Justice Department was still discussing whether to cite his role. Some officials feared that the extra attention might hinder efforts to capture him. …
Current and former counterterrorism officials discussed the case on condition of anonymity because they were not authorized to speak about it.
Shukrijumah, 34, has eluded the FBI for years. The Saudi-born terrorist studied at a community college in Florida, but when the FBI showed up to arrest him as a material witness to a terrorism case in 2003, he already had left the country. The U.S. is offering a $5 million reward for information leading to his capture.
Intelligence officials began unraveling the subway plot last year, when U.S. intelligence intercepted an e-mail from an account that al-Qaida had used in a recent terrorist plot, officials said. The e-mail discussed bomb-making techniques and was sent to an address in Denver, setting off alarms within the CIA and FBI from Islamabad to the U.S.
Najibullah Zazi and two friends were arrested in September 2009 before, prosecutors said, they could carry out a trio of suicide bombings in Manhattan. Zazi and Zarein Ahmedzay have pleaded guilty and admitted planning to detonate homemade bombs on the subway during rush hour. A third man, Adis Medunjanin, awaits trial.
A fourth suspect, a midlevel al-Qaida operative known as Ahmed, traded the e-mails with Zazi, who was frantically trying to perfect his bomb making recipe, officials said. The U.S. wants to bring the Pakistani man to the U.S. for trial on charges that are not yet public.
Pakistani officials also have arrested a fifth person, known as Afridi, who worked with Ahmed, officials said.
Rolf Mowatt-Larssen, currently a Senior Fellow at Harvard’s Kennedy School of Government Belfer Center for Science and International Affairs, previously Director of Intelligence and Counterintelligence at the U.S. Department of Energy and Chief of the Weapons of Mass Destruction Department for the CIA, has published a 32-page report, Al Qaeda Weapons of Mass Destruction Threat: Hype or Reality?, which asks the obvious question:
Why hasn’t there been an attack up to now by al Qaeda utilizing WMD?
To date, al Qaeda’s WMD programs may have been disrupted. This is in fact one likely explanation, given a sustained and ferocious counterterrorist response to 9/11 that largely destroyed al Qaeda as the organization that existed before the fateful attack on the US. If so, terrorists must continue to be disrupted and denied a safe haven to reestablish the ability to launch a major strike on the US homeland, or elsewhere in the world. …
Or perhaps, al Qaeda operational planners have failed to acquire the kind of weapons they seek, because they are unwilling to settle for anything other than a large scale attack in the US. …
[I]f Osama bin Ladin and his lieutenants had been interested in employing crude chemical, biological and radiological materials in small scale attacks, there is little doubt they could have done so by now. However, events have shown that the al Qaeda leadership does not choose weapons based on how easy they are to acquire and use. …
An examination of the 9/11 attack sheds light on al Qaeda’s reasoning behind the selection of specific weapons, and how that may apply to the role WMD plays in their thinking. Al Qaeda opted to pursue a highly complex and artfully choreographed plot to strike multiple targets requiring the simultaneous hijacking of several 747 jumbo passenger aircraft, because using airplanes as weapons offered the best means of attacking the targets they intended to destroy. If conventional wisdom on assessing WMD terrorism threats had been applied to considering the likelihood of the 9/11 plot, analysts may well have concluded it never would have happened; at the time, it was simply hard to believe any terrorist group could pull off such an elaborate plot utilizing novel, unpredictable weapons that were so difficult to acquire.

Graham Allison summarizes the evidence of that chronology in a forward to the report:
This chronology teaches us four important lessons. First, al Qaeda’s top leadership has demonstrated a sustained commitment to buy, steal or construct WMD. In 1998, Osama bin Laden declared that “acquiring WMD for the defense of Muslims is a religious duty.†In December 2001, bin Laden’s Deputy Ayman Zawahiri stated, “If you have $30 million, go to the black market in the central Asia, contact any disgruntled Soviet scientist and a lot of dozens of smart briefcase bombs are available.†A few months later, al Qaeda announced its goal to “kill four million Americans.â€
Second, al Qaeda was prepared to expend significant resources to cultivate a WMD capability even during the planning phases of 9/11. In the years leading up to September 2001, we see that bin Laden’s organization never lost its focus on WMD, even while coordinating the 9/11 attacks, orchestrating the simultaneous bombings of the U.S. embassies in Tanzania and Kenya in 1998, and successfully striking the U.S. warship (USS Cole) in 2000.
Third, a clear hallmark of al Qaeda’s WMD approach is to pursue parallel paths to procure these deadly materials. Multiple nodes of the network were assigned to different tasks of the overall WMD effort, acting and reporting independently, ensuring that failure in one cell did not jeopardize the entire operation. By taking into account possible operational set-backs and intelligence breaches, al Qaeda has displayed deliberate, shrewd planning to acquire WMD.
Fourth, al Qaeda has taken part in joint development of WMD with other terrorist groups. This collaboration between the most senior members of separate organizations demonstrates that interest in and motivation to possess WMD are not limited to a single group.

The single most alarming detail must be:
Pakistani humanitarian NGO Umma Tameer e Nau (UTN), which was founded by Pakistani nuclear scientists with close ties to al Qaeda and the Taliban. UTN was headed by Bashiruddin Mahmood, who had been chief of Pakistan’s Khushab plutonium reactor. … Sometime before August 2001, UTN CEO Bashiruddin Mahmood offer[ed] to construct chemical, biological and nuclear weapons programs for al Qaeda and Libya, in two separate, discreet approaches. …
Mahmood confesses that he was introduced to al Qaeda seniors in Afghanistan in summer 2001, met with Osama bin Ladin around a campfire, and they discussed how al Qaeda could build a nuclear device. Mahmood drew a very rough sketch of an improvised nuclear device. When Mahmood advised Osama bin Ladin that it would be too hard for his group to undertake a nuclear weapons program and develop the billion dollar infrastructure for weapons-usable materials, bin Ladin queries, “What if I already have it? (the nuclear material)â€
After KSM was captured by the United States, he was not initially cooperative with CIA interrogators. …
After he was subjected to the “waterboard†technique, KSM became cooperative, providing intelligence that led to the capture of key al Qaeda allies and, eventually, the closing down of an East Asian terrorist cell that had been tasked with carrying out the 9/11-style attack on Los Angeles.

A new video called “Nuclear Terrorism” has been posted on the worldwide web calling for jihadists to use nuclear or chemical weapons to strike the west.
A simple jihadi propaganda video or a dangerous message to a sleeper cell in the west? That is the question raised by the video and no-one has yet claimed responsibility for it.
“Strike civilians in the west without mercy using weapons of mass destruction” is one of the calls made in the 39-minute video.
The question now being asked is whether the video is presenting a coded message or signalling an imminent terrorist attack.

The latest audio message from al-Qaeda, reportedly from Osama bin Laden himself, is only the most recent confirmation that the jihadist threat to the West remains real and deadly serious. But the fact that it could take the form of nuclear terrorism should be most worrying to citizens and policy makers alike.
Where a nuclear attack once may have been beyond the capacities of stateless terrorists, that is no longer the case. …
‘Jafer the Pilot” is the nom de guerre of U.S. citizen Adnan el-Shukrijumah. Young, intelligent, fluent in multiple languages and a trained jet pilot who had apparently been in flight schools with Mohammed Atta, Shukrijumah had studied and worked with other jihadis at the 5-megawatt nuclear reactor at McMaster University in Canada. But one day all the terrorists disappeared from campus forever.
John Loftus of WABC news reported on November 7, 2003, that in the immediate wake of Shukrijumah and his fellow travelers’ disappearance, 180 pounds of uranium ended up “missing†from the reactor. Pakistani journalist Hamid Mir, who interviewed Osama bin Laden in the wake of 9/11, reported bin Laden saying that one of the founders of al-Qaeda, Anas el-Liby, had helped the Pilot haul out the stash of uranium.
McMaster U. has always insisted that no material was ever missing from the reactor, but instead claims that low-grade radiological material did turn up missing from their pharmacological/medical labs at the time. Paul Williams, author of The Day of Islam, published the Loftus-Mir assertions in his book and elsewhere. For his trouble, he was promptly sued by the University for $4,000,000. The suit is still pending. …
(Shukrijumah) was seen again in Mexico in late August 2004, near “terrorist alley†in Sonora, the main thoroughfare for illegal aliens into the United States. [The violent street gang MS-13 (Mara Salvatruchas)] was the Pilot’s new supply chain and courier of nuclear material for the bombs he was setting up. …
The International Atomic Energy Agency (IAEA) has documented 15 incidents of theft and smuggling of small amounts of separated plutonium or highly enriched uranium confirmed by the nations involved. But these 15 cases represent the tip of the iceberg of what has actually occurred. So there is always just approaching the right people and buying it—not an easy task, but not an impossible one either. …
In February 2006, Russian citizen Oleg Khinsagov was arrested in Georgia (along with three Georgian accomplices) with some 100 grams of 89 percent enriched HEU, claiming that he had kilograms more available for sale. We can’t know how many thefts that occurred were never detected. Dr. Bunn told Senator Lieberman that “it is a sobering fact that nearly all of the stolen HEU and plutonium that has been seized over the years had never been missed before it was seized.â€
The Pilot doesn’t need too much HEU for his seven-city destruction plan. For one “simple†gun-type design HEU bomb, roughly 50 kilograms of HEU would be needed – roughly the size of a six-pack.
The Pilot could also try hitting up a HEU-based research facility, like his old alma mater McMaster University, although McMaster apparently didn’t employ HEU per se. But some 130 research reactors around the world still do use HEU as their fuel.
Or has he already? The Washington Post, right before last Christmas, reported a strange story. Sometime in the night of November 8, 2007, two coordinated teams of armed men attacked the Pelindaba nuclear facility in South Africa, where hundreds of kilograms of weapon-grade highly enriched uranium (HEU) are stored.
One of the teams was chased off by the guards, but the other team of four gunmen disabled the perimeter alarms, went to the emergency control center and shot a worker in the chest. Bleeding out, the worker was still able to sound the first alarm.
He might not have bothered. The attack team then spent 45 minutes inside the perimeter, without anyone harassing them. What they did next is unknown to the public. The team promptly disappeared through the same hole they had cut in the fence. South African officials later arrested three individuals, but soon released them. The South African government has since been close-lipped about what really happened last November, and it has refused earlier U.S. offers to remove the HEU at Pelindaba—if indeed any remains after the attack. We don’t even know how much HEU, if any, was spirited away.
But surely the point is not whether the Pilot hit this specific facility. It is that he could well have—or dozens of others like it. We do know that if a 10 kiloton A-bomb, somewhat smaller than the bomb that obliterated Hiroshima, is set off at ground level in midtown Manhattan, the death toll would be perhaps half a million people. We could expect roughly $1 trillion in direct economic damage from this one bomb alone. Multiply this by seven bombs, and we can expect the wholesale depopulation of America’s cities in fear, incalculable economic devastation, and the end of the country as we currently know it.
The Wall Street Journal notes a certain irony in the characteristic choice of pro bono activity expressive of today’s cultural values at an elite institution like Yale Law School.
John Yoo can be forgiven if he’s having second thoughts about his career choice. A Yale Law School graduate, the Berkeley professor of law went on to serve his country at the Justice Department. Yet last week he was sued by convicted terrorist Jose Padilla and his mother, who are represented by none other than lawyers at Yale. Perhaps if Mr. Yoo had decided to pursue a life of terrorism, he too could be represented by his alma mater.
Padilla is the American citizen who was arrested in 2002, and detained as an “enemy combatant” in a military brig in Charleston, S.C., under suspicion of plotting to set off a radioactive “dirty bomb” in a U.S. city. Padilla fought his detention on Constitutional grounds, losing his case in the Fourth Circuit Court of Appeals.
In January 2006, the feds transferred him out of military custody to be tried in civilian court in Miami. The dirty bomb charge was never filed because the military hadn’t read him his Miranda rights or provided him a lawyer when he was interrogated. A jury nonetheless took a day and half last August to convict him of conspiracy to murder, kidnap and maim people overseas. Padilla could get life in prison.
Mr. Yoo is the former deputy assistant attorney general who wrote memos laying out some of the legal parameters in the war on terror. Those memos most famously pertained to interrogation techniques, some of which were used against such enemy combatants as Padilla. Mr. Yoo long ago returned to Berkeley, and we are happy to say he sometimes writes for us.
Now, years later, Mr. Yoo is being harassed by a lawsuit claiming he is personally liable for writing those memos as a midlevel government official. “Defendant Yoo subjected Mr. Padilla to illegal conditions of confinement and treatment that shocks the conscience in violation of Mr. Padilla’s Fifth Amendment Rights to procedural and substantive due process,” the complaint asserts.
But Padilla’s rights weren’t violated, and certainly not by Mr. Yoo, whose legal arguments at the time were accepted by his superiors, including Attorney General John Ashcroft. The decision to hold Padilla as an enemy combatant was made by President Bush, and defended in court by executive branch lawyers. They won that case in the most senior court in which it was heard, in an opinion written by then-Judge Michael Luttig of the Fourth Circuit. The Bush Administration later transferred Padilla to be tried in the Miami court, and the Supreme Court declined to hear an appeal. Padilla got his day in court — on both Constitutional and criminal grounds — and lost.
What we really have here is less a tort claim than a political stunt intended to intimidate government officials. Nothing in the claim will change Padilla’s future, and the suit asks for only $1 in damages, plus legal fees. Instead, the suit seeks “a judgment declaring that the acts alleged herein are unlawful and violate the Constitution and laws of the United States.” In short, the Yale attorneys are using Padilla as a legal prop in one more attempt to find a judge willing to declare that the Bush Administration’s antiterror policies are illegal. And if it can harass Mr. Yoo with bad publicity and legal costs along the way, so much the better.
This is nasty business and would have damaging consequences if it worked. Government officials have broad legal immunity (save for criminal acts) precisely so they can make decisions without worrying about personal liability. If political appointees can be sued years later for advice that was accepted by their superiors, we will soon have a government run not by elected officials but by tort lawyers and judges.
The antiwar left has failed to overturn U.S. policies in Congress, or by directly challenging the government in court. So its latest tactic is suing third parties, such as the telephone companies that cooperated on al Qaeda wiretaps after 9/11. And now it is suing former government officials, hoping to punish them and deter future appointees from offering any advice that the left dislikes.
Which brings us back to Yale. The real litigant here is the National Litigation Project at the Lowenstein International Human Rights Clinic at Yale Law School. That sounds august, but this is really a leftwing bucket shop using Yale’s sponsorship to achieve antiwar policy goals via lawsuit. We trust the dean of Yale Law, Harold Koh, is proud of suing an alumnus on behalf of a terrorist, and that Yale’s other alumni know how their donations are being used.

On Sunday, October 22nd, 2006, there will be seven “dirty” explosive devices detonated in seven different U.S. cities; Miami, New York City, Atlanta, Seattle, Houston, Oakland and Cleveland. The death toll will approach 100,000 from the initial blasts and countless other fatalities will later occur as result from radioactive fallout.
The bombs themselves will be delivered via trucks. These trucks will pull up to stadiums hosting NFL games in each respective city. All stadiums to be targeted are open air arenas, excluding Atlanta’s Georgia Dome, the only enclosed stadium to be hit. Due to the open air, the radiological fallout will destroy those not killed in the initial explosion. The explosions will be near simultaneous, with the cities specifically chosen in different time zones to allow for multiple attacks at the same time.
The 22nd of October will mark the final day of Ramadan as it would fall in Mecca. Al-Qaida will automatically be blamed for the attacks. Later, through Al-Jazeera Osama bin Laden will issue a video message claiming responsibility for what he dubs “America’s Hiroshima”.
In the aftermath civil wars will erupt across the world, both in the Middle East and within the United States. Global economies will screech to a halt. General chaos will rule.
AP reported the story, including expressions of skepticism from the authorities.
The warning, posted Oct. 12, was part of an ongoing Internet conversation titled “New Attack on America Be Afraid.” It mentioned NFL stadiums in New York, Miami, Atlanta, Seattle, Houston, Oakland and Cleveland, where games are scheduled to be held this weekend.
The Homeland Security Department alerted authorities and stadium owners in those cities, as well as the NFL, of the Web message but said the threat was being viewed “with strong skepticism.” Officials at the NCAA, which oversees college athletics, said they too had been notified.
Homeland Security spokesman Russ Knocke said there was no intelligence that indicated such an attack was imminent, and he said the alert was “out of an abundance of caution.”
“The department strongly encourages the public to continue to go about their plans, including attending events that involve large public gatherings such as football games,” Knocke said.
The FBI also expressed doubt about the threat.
“While the credibility of the threat is questionable, we have passed the information on because it has been carried in some open source reporting,” said FBI spokesman Richard Kolko. He said the FBI was discussing the threat with the NFL as “part of our routine discussions this week.”
The nation’s alert level remains at yellow, signaling an elevated risk of an attack. The threat level for airline flights is at orange, a higher level, where it has been since a foiled plot to bomb U.S.-bound commercial jets was revealed on Aug. 10.
This one does not seem terribly credible, but a little heightened security would not be a bad idea.

He was first taken into custody by police in Wauwatosa on Wednesday, based on information authorities received that Brahm was the source of the Internet threat to bomb football stadiums, federal authorities said.
FBI agents interviewed him that night, and the FBI said Thursday it had determined the threats were a hoax.
