Democrat control of either house of Congress will almost certainly result in grandstanding Congressional committees investigating alleged violations of international law and human rights in the detention and interrogation of terrorists. It has been generally recognized that restraints on US Intelligence operations imposed as a result of the 1970s Frank Church-led CIA hearings had a great deal to do with the government’s failure to prevent the 9/11 attacks. The consequences of another Congressional Intelligence witch hunt are likely to be just as devastating.
The Washington Post reports that CIA officers are buying Congressional politics insurance.
It takes our own unique combination of vicious partisanship, habitual domestic treason, and opportunistic litigation to produce the need for such insurance for those who protect America from foreign enemies. CIA counterterrorism officers have signed up in growing numbers for a government-reimbursed, private insurance plan that would pay their civil judgments and legal expenses if they are sued or charged with criminal wrongdoing, according to current and former intelligence officials and others with knowledge of the program…
Justice Department political appointees have strongly backed the CIA interrogations. But “there are a lot of people who think that subpoenas could be coming” from Congress after the November elections or from federal prosecutors if Democrats capture the White House in 2008, said a retired senior intelligence officer who remains in contact with former colleagues in the agency’s Directorate of Operations, which ran the secret prisons.
“People are worried about a pendulum swing” that could lead to accusations of wrongdoing, said another former CIA officer.
The insurance policies were bought from Arlington-based Wright and Co., a subsidiary of the private Special Agents Mutual Benefit Association created by former FBI officials. The CIA has encouraged many of its officers to take out the insurance, current and former intelligence officials said, but no one interviewed would reveal precisely how many have bought policies…
The insurance, costing about $300 a year, would pay as much as $200,000 toward legal expenses and $1 million in civil judgments. Since the late 1990s, the CIA’s senior managers have been eligible for reimbursement of half the insurance premium.
In December 2001, with congressional authorization, the CIA expanded the reimbursements to 100 percent for CIA counterterrorism officers. That was about the time J. Cofer Black, then the CIA’s counterterrorism chief, told Bush that “the gloves come off” and promised “heads on spikes” in the counterterrorism effort.
“Why would [CIA officers] take any risks in their professional duties if the government was unwilling to cover the cost of their liability?” asked Rep. Rob Simmons (R-Conn.), a former CIA officer, during congressional debate that year.
Although suing federal officials for their actions is not easy, it is possible; the Supreme Court left the door ajar in two rulings. It ruled in 1971 that six narcotics agents could be sued for monetary damages arising from a warrantless search. Eleven years later, it held that government officials should be immune from civil liability only if their conduct does not violate clear statutory or constitutional rights that should be known by “a reasonable person.”
William L. Bransford, a senior partner at the law firm that defends people who take out the insurance, said he is unaware of any recent increase in claims. But agency officials said that interest has been stoked over the years by the $2 million legal bill incurred by CIA officer Clair George before his 1992 conviction for lying to Congress about the Iran-contra arms sales; by the Justice Department’s lengthy investigation of CIA officers for allegedly lying to Congress about the agency’s role in shooting down a civilian aircraft in 2001 in Peru; and by other events.
CIA employees outside the counterterrorism field who are eligible for reimbursement include the agency’s supervisors, attorneys, equal-opportunity- employment counselors, auditors, polygraph examiners, security adjudicators, grievance officers, inspectors general and internal investigators, he said. One in 10 eligible employees sought reimbursement last year, Mansfield said, adding that the fraction from previous years and a breakdown on those in the counterterrorism field were not immediately available.

ABC’s redacted Path to 9/11 concluded tonight. All sophisticated viewers, I think, agree with John Fund, that, however slightly fictionalized, docudramas based on events within living memory are a fundamentally bad idea. There is simply no legitimate way to combine the needs of theatre with factuality.
Although I’m no admirer of the genre, I thought Path to 9/11 was not entirely a bad thing. It seemed to me that the television mini-series represented our culture’s collective unconsciousness, whispering in our ear a (basically valid) warning about the sclerotic tendencies of large institutions faced with unprecedented challenges. I don’t think any of the purported facts were terribly far off the mark, and the spectacular reaction of William Jefferson Clinton, a number of officials from his administration, and the Democrat Congressional leadership was every bit as entertaining as the program.

The merry gang of former John Kerry supporters in control of the US Intelligence Community under the Bush Administration have produced two extremely partisan reports, establishing that they were right all along: Saddam Hussein was perfectly harmless, had no WMDs, and had nothing to do with Al Qaeda or terrorism generally, and Bush lied.
These conclusions are reached by the artful selection of data, and by systematically dismissing the sources of all evidence to the contrary of a preferred reality as unreliable on a variety of questionable bases. This source spoke to the Press, that proves he’s lying. And that source took a job with the Iraqi opposition, obviously he was always peddling propaganda on their behalf. If you throw out every piece of evidence you don’t like, using any convenient rationalization, it isn’t difficult to arrive at the conclusions you desired all along.
The reports were adopted, and amended, in a series of partisan votes, in which so-called Republican Senators Olympias Snowe (Maine) and Chuck Hagel (Nebraska) voted with the democrats.

Today’s Wall Street Journal explains why Pakistan’s government found it necessary to make peace with the Taliban and other jihadis in the North-West Frontier Province.
Pakistan’s decision to end a military offensive against Islamic militants in the country’s troubled northwest frontier reflects mounting pressure on President Pervez Musharraf to deal with an even bigger security problem: a growing rebellion in the resource-rich province of Baluchistan.
Political analysts say Gen. Musharraf, boxed in by a pair of increasingly costly conflicts, has been forced to focus on the more important political threat to his government — the Baluch separatist movement — even if it means U.S.-led forces across a porous border in Afghanistan could pay a price for the Pakistani military’s withdrawal from the northwest region of Waziristan.
Under a cease-fire agreement struck this week between tribal chieftains and the military, a three-year government campaign against Islamic militants in Waziristan ended. The military released hundreds of prisoners taken in the rugged tribal area and granted amnesty to others, including some with known links to al Qaeda. Soldiers have vacated advance outposts in the region and relocated to a nearby army camp, according to a senior military official…
One of the brokers of the deal was a retired general now serving as governor of Pakistan’s North West Frontier Province, which includes Waziristan. Gov. Ali Mohammed Jan Orakzai, who comes from a tribal area, argued that the military’s campaign in Waziristan had been counterproductive. “Extremism is more a mind-set,” concurred Pakistan’s senior military spokesman, Gen. Shaukat Sultan. “You don’t open up every mind through use of force.”
In Baluchistan, meanwhile, the military’s drive to put down a separatist rebellion has intensified, sparking violent protests in the region and beyond, which grew after separatist leader Akbar Khan Bugti was killed by security forces late last month. Baluch nationalists have been demanding greater political autonomy from Islamabad and a bigger share of the region’s resources, which include large natural-gas reserves.

Bill Roggio‘s coverage points to some very alarming details, not mentioned by the mainstream media.
The “truce” is in fact a surrender. According to an anonymous intelligence source, the terms of the truce includes:
– The Pakistani Army is abandoning its garrisons in North and South Waziristan.
– The Pakistani Military will not operate in North Waziristan, nor will it monitor actions the region.
– Pakistan will turn over weapons and other equipment seized during Pakistani Army operations.
– The Taliban and al-Qaeda have set up a Mujahideen Shura (or council) to administer the agency.
– The truce refers to the region as “The Islamic Emirate of Waziristan.”
– An unknown quantity of money was transferred from Pakistani government coffers to the Taliban. The Pakistani government has essentially paid a tribute or ransom to end the fighting.
– “Foreigners” (a euphemism for al-Qaeda and other foreign jihadis) are allowed to remain in the region.
– Over 130 mid-level al-Qaeda commanders and foot soldiers were released from Pakistani custody.
– The Taliban is required to refrain from violence in Pakistan only; the agreement does not stipulate refraining from violence in Afghanistan.
The truce meeting was essentially an event designed to humiliate the Pakistani government and military. Government negotiators were searched for weapons by Taliban fighters prior to entering the meeting. Heavily armed Taliban were posted as guards around the ceremony. The al Rayah — al-Qaeda’s black flag — was hung over the scoreboard at the soccer stadium where the ceremony was held. After the Pakistani delegation left, al-Qaeda’s black flag was run up the flagpole of military checkpoints and the Taliban began looting the leftover small arms. The Taliban also held a ‘parade’ in the streets of Miranshah. They openly view the ‘truce’ as a victory, and the facts support this view.
While this is not reported in the media, the “Taliban commanders” in attendance include none other than Jalaluddin Haqqani, military commander of the Taliban in Afghanistan, and Tahir Yuldashev, the commander of the Islamic Movement of Uzbekistan.

To add insult to the defeat of the Waziristan truce, Pakistan has openly admitted that it would let Osama bin Laden remain a free man if committed to living a peaceful existance in the region. “If he is in Pakistan, bin Laden ‘would not be taken into custody,’ Major General Shaukat Sultan Khan told ABC News in a telephone interview, ‘as long as one is being like a peaceful citizen,” reports ABC News’ The Blotter. An independent intelligence source confirms Maj. Gen. Shaukat Sultan Khan’s position is an accurate reflection of Pakistani policy.

David Corn, co-author of Hubris, the book which revealed Richard Armitage as Valerie Plame’s leaker, is spinning some more of the background detail in Nation article.
Corn gives this precis of Plame’s CIA career.
Valerie Plame was recruited into the CIA in 1985, straight out of Pennsylvania State University. After two years of training to be a covert case officer, she served a stint on the Greece desk, according to Fred Rustmann, a former CIA official who supervised her then. Next she was posted to Athens and posed as a State Department employee. Her job was to spot and recruit agents for the agency. In the early 1990s, she became what’s known as a nonofficial cover officer. NOCs are the most clandestine of the CIA’s frontline officers. They do not pretend to work for the US government; they do not have the protection of diplomatic immunity. They might claim to be a businessperson. She told people she was with an energy firm. Her main mission remained the same: to gather agents for the CIA.
In 1997 she returned to CIA headquarters and joined the Counterproliferation Division. (About this time, she moved in with Joseph Wilson; they later married.) She was eventually given a choice: North Korea or Iraq. She selected the latter. Come the spring of 2001, she was in the CPD’s modest Iraq branch. But that summer–before 9/11–word came down from the brass: We’re ramping up on Iraq. Her unit was expanded and renamed the Joint Task Force on Iraq. Within months of 9/11, the JTFI grew to fifty or so employees. Valerie Wilson was placed in charge of its operations group.

It is clear that the purpose of the article is to shore up the central thesis of the Anti-Bush Intel Op, the thesis that Intelligence Community professionals told the Bush Administration that Saddam was innocent, there were no WMDs and an invasion of Iraq would be unjustified, but the wicked Neocons around Dick Cheney ignored the facts supplied by experts and professionals, and led the nation into a ruinous and unnecessary war.
By Corn’s account, rather than a bit player (just a camp follower member of the Enlightened Community of Pouting Spooks Opposing Bush), Valerie Plame was really one of the most important experts and professionals who knew better.
There was great pressure on the JTFI to deliver. Its primary target was Iraqi scientists. JTFI officers, under Wilson’s supervision, tracked down relatives, students and associates of Iraqi scientists–in America and abroad–looking for potential sources. They encouraged Iraqi émigrés to visit Iraq and put questions to relatives of interest to the CIA. The JTFI was also handling walk-ins around the world. Increasingly, Iraqi defectors were showing up at Western embassies claiming they had information on Saddam’s WMDs. JTFI officers traveled throughout the world to debrief them. Often it would take a JTFI officer only a few minutes to conclude someone was pulling a con. Yet every lead had to be checked.
“We knew nothing about what was going on in Iraq,” a CIA official recalled. “We were way behind the eight ball. We had to look under every rock.” Wilson, too, occasionally flew overseas to monitor operations. She also went to Jordan to work with Jordanian intelligence officials who had intercepted a shipment of aluminum tubes heading to Iraq that CIA analysts were claiming–wrongly–were for a nuclear weapons program. (The analysts rolled over the government’s top nuclear experts, who had concluded the tubes were not destined for a nuclear program.)
The JTFI found nothing. The few scientists it managed to reach insisted Saddam had no WMD programs. Task force officers sent reports detailing the denials into the CIA bureaucracy. The defectors were duds–fabricators and embellishers. (JTFI officials came to suspect that some had been sent their way by Ahmad Chalabi’s Iraqi National Congress, an exile group that desired a US invasion of Iraq.) The results were frustrating for the officers. Were they not doing their job well enough–or did Saddam not have an arsenal of unconventional weapons? Valerie Wilson and other JTFI officers were almost too overwhelmed to consider the possibility that their small number of operations was, in a way, coming up with the correct answer: There was no intelligence to find on Saddam’s WMDs because the weapons did not exist.
Note the nice try by Corn, identifying one specific trip to Jordan to discuss aluminum tubes, and alluding darkly to very unspecific “occasional trips overseas” (very possibly merely to conferences, conventions, and liaison meetings with allies), intended to provide the essential predicate for the applicability of the Intelligence Identities Protection Act of 1982.

Roger L. Simon puts the mainstream media on the couch:
what interests me is how the Plame Affair fits into the whole framework. It may be opera bouffe, but it is far from unrelated to the way the press has conducted itself in recent years. Is it so different from Pallywood and the Mohammed Al Doura case, the Reuters photographs, the Jenin “massacre” and so forth – all lies swallowed whole by a gullible Western media? At first glance they would seem far apart, but in this small world one concept draws them all together – narrative. The truth is less important than the weltanschauung of the publication. But we knew that, didn’t we?
So next step – why this phenomenon? Why the acceptance of this narrative whose result is so negative to world history and seems in continuous aid of the destruction of the Enlightenment itself? Is it just Bush Derangement Syndrome? Well, I think that’s a large part of it. But the term (BDS) is too narrow to encompass the phenomenon. A variety of psychological forces are in the mix, but most notable to me is a sense of deprivation. 9/11 stripped the left of its self-perceived idealism that was the mainstay of its “personality.” Forces (like Bush) that lefties once dismissed as reactionary were taking the lead in the preservation of the West instead of supporting dictators as they once did. Furthermore, in the old days the left could take concilation that the enemy (communism) had at least a theoretical rationale – economic fairness to all. The new enemy was more troublesome – on the one hand poor (only seemingly, of course, considering the oil rich) and on the other hand medieval, anti-woman, anti-gay and anti-modern… essentially anti-liberal. What to do…. what to do?
In the beginning the left went along with Bush, but the minute things began to lag in Iraq, they deserted him in a flash. At first glance the reason was political but on a deeper (and I believe more important) level the reason was psychological. The left was in a rush to reclaim its lost idealism (the “it’s about oil” nonsense was but an obvious example of this), to preserve its disintegrating sense of self. Of course the big loser in all this is the truth. Sure Bush made a bunch of mistakes (who wouldn’t?) but it should be obvious to anyone that we are at the earliest stages of a very long war. Nevertheless, a culture of media corruption set in almost instantly that ended up creating absurdities like the Plame Affair. We are lucky this one got unmasked. We will also be lucky if the conclusions drawn in the WaPo editorial stick for that publication at least. We shall see.

Former Secretary of the Navy John Lehman, no democrat, evaluates the Bush administration’s policies, accomplishments, and failures.
We are at war with jihadists motivated by a violent ideology based on an extremist interpretation of the Islamic faith. This enemy is decentralized and geographically dispersed around the world. Its organizations range from a fully functioning state such as Iran to small groups of individuals in American cities.
We are fighting this war on three distinct fronts: the home front, the operational front and the strategic-political front. Let us look first at the home front. The Bush administration deserves much credit for the fact that, despite determined efforts to carry them out, there have been no successful Islamist attacks within the United States since Sept. 11, 2001. This is a significant achievement, but there are growing dangers and continuing vulnerabilities…
One of the most deep-seated of these problems is the U.S. government’s tendency to treat this war as a law enforcement issue. Following a recommendation of the Sept. 11 commission, Congress sought to remedy this problem by creating a national security service within the FBI to focus on preventive intelligence rather than forensic evidence. This has proved to be a complete failure. As late as June of this year, Mark Mershon of the FBI testified that the bureau will not monitor or surveil any Islamist unless there is a “criminal predicate.” Thus the large Islamist support infrastructure that the commission identified here in the United States is free to operate until its members actually commit a crime.
Our attempt to reform the FBI has failed. What is needed now is a separate domestic intelligence service without police powers, like the British MI-5…
Turning to the operational front, our objectives are to destroy the capability of Islamist organizations to attack us and to deny them geographic sanctuaries in which they can recruit, train and operate.
The post-Sept. 11 threat demanded preemptive attack against Islamist bases, and this was done without delay in the invasion of Afghanistan to destroy al-Qaeda and remove the Taliban government, its ally and supporter. It was a brilliantly executed operation in which all our armed forces and CIA operatives combined in a ruthlessly efficient victory. In the succeeding years, however, the Taliban and al-Qaeda have been able to regroup, rebuild and re-attack because they enjoy a secure sanctuary largely free from attack within the border areas of Pakistan.
The next military operation of the war was, of course, the invasion of Iraq. Here again the combined military operations of the United States and Britain were brilliantly successful in defeating Iraqi forces and removing Saddam Hussein and his regime. But in the aftermath of that victory, grave blunders were made. There was a total misunderstanding of the requirements for successful occupation.
Defense Secretary Donald Rumsfeld was proved right in his keeping the initial invasion force small and agile, but desperately wrong in disbanding all Iraqi security forces and civil service with no plan to fill the resulting vacuum. Certainly it is hard now to understand the logic of that decision.
The military occupation in Iraq is consuming practically the entire defense budget and stretching the Army to its operational limits. This is understood quite clearly by both our friends and our enemies, and as a result, our ability to deter enemies around the world is disintegrating.
This brings us to the third front, the strategic-political. The jihadist regime in Iran feels no reservation about flaunting its policy to go nuclear, and it unleashed Hezbollah, its client terrorist organization, to attack Israel. In Somalia a jihadist group has seized control of the government. In Pakistan, Islamists are becoming more powerful, and attacks within India are increasing. Governments in Indonesia, Malaysia, Egypt, Algeria and Jordan are under increasing Islamist pressure. In the Pacific, North Korea now feels free to rattle its missile sabers, firing seven on America’s Independence Day. China is rapidly building its 600-ship navy to fill the military vacuum that we are creating in the Pacific as our fleet shrinks well below critical mass. Not one of these states believes that we can undertake any credible additional military operations while we are bogged down in Iraq.
The indoctrination and recruiting of jihadists from Indonesia, South Asia and the Middle East are carried out through religious establishments that are supported overwhelmingly by the Saudi and Iranian governments. Even in the United States, some 80 percent of Islamic mosques and schools are closely aligned with the Wahhabist sect and heavily dependent on Saudi funding. Five years after Sept. 11, nothing has been done to materially affect this root source of jihadism. The movement continues to grow, fueled by an ever-increasing flow of petrodollars from the Persian Gulf.
There is no evidence that the administration has ever raised this matter with the Saudi government as a high-level issue, and — just as damaging — it has never acknowledged it as an issue to the American people. Thus Rumsfeld’s question — are we killing, capturing or deterring jihadists faster than they are being produced? — must be answered with an emphatic no.
In reviewing progress on the three fronts of this war, even the most sanguine optimist cannot yet conclude that we are winning or that we can win without some significant changes of policy.

Douglas R. Burgess Jr. makes the argument again that Islamic terrorists should be being viewed legally as a contemporary species of pirate.
More than 2,000 years ago, Marcus Tullius Cicero defined pirates in Roman law as hostis humani generis, “enemies of the human race.” From that day until now, pirates have held a unique status in the law as international criminals subject to universal jurisdiction—meaning that they may be captured wherever they are found, by any person who finds them. The ongoing war against pirates is the only known example of state vs. nonstate conflict until the advent of the war on terror, and its history is long and notable. More important, there are enormous potential benefits of applying this legal definition to contemporary terrorism…
Until 1856, international law recognized only two legal entities: people and states. People were subject to the laws of their own governments; states were subject to the laws made amongst themselves. The Declaration of Paris created a third entity: people who lacked both the individual rights and protections of law for citizens and the legitimacy and sovereignty of states. This understanding of pirates as a legally distinct category of international criminals persists to the present day, and was echoed in the 1958 and 1982 U.N. Conventions on the Law of the Sea. The latter defines the crime of piracy as “any illegal acts of violence or detention, or any act of depredation, committed for private ends.” This definition of piracy as private war for private ends may hold the crux of a new legal definition of international terrorists…
TO UNDERSTAND THE POTENTIAL OF DEFINING TERRORISM as a species of piracy, consider the words of the 16th-century jurist Alberico Gentili’s De jure belli: “Pirates are common enemies, and they are attacked with impunity by all, because they are without the pale of the law. They are scorners of the law of nations; hence they find no protection in that law.” Gentili, and many people who came after him, recognized piracy as a threat, not merely to the state but to the idea of statehood itself. All states were equally obligated to stamp out this menace, whether or not they had been a victim of piracy. This was codified explicitly in the 1856 Declaration of Paris, and it has been reiterated as a guiding principle of piracy law ever since. Ironically, it is the very effectiveness of this criminalization that has marginalized piracy and made it seem an arcane and almost romantic offense. Pirates no longer terrorize the seas because a concerted effort among the European states in the 19th century almost eradicated them. It is just such a concerted effort that all states must now undertake against terrorists, until the crime of terrorism becomes as remote and obsolete as piracy.
But we are still very far from such recognition for the present war on terror. President Bush and others persist in depicting this new form of state vs. nonstate warfare in traditional terms, as with the president’s declaration of June 2, 2004, that “like the Second World War, our present conflict began with a ruthless surprise attack on the United States.” He went on: “We will not forget that treachery and we will accept nothing less than victory over the enemy.” What constitutes ultimate victory against an enemy that lacks territorial boundaries and governmental structures, in a war without fields of battle or codes of conduct? We can’t capture the enemy’s capital and hoist our flag in triumph. The possibility of perpetual embattlement looms before us.
If the war on terror becomes akin to war against the pirates, however, the situation would change. First, the crime of terrorism would be defined and proscribed internationally, and terrorists would be properly understood as enemies of all states. This legal status carries significant advantages, chief among them the possibility of universal jurisdiction. Terrorists, as hostis humani generis, could be captured wherever they were found, by anyone who found them. Pirates are currently the only form of criminals subject to this special jurisdiction.
Second, this definition would deter states from harboring terrorists on the grounds that they are “freedom fighters” by providing an objective distinction in law between legitimate insurgency and outright terrorism. This same objective definition could, conversely, also deter states from cracking down on political dissidents as “terrorists,” as both Russia and China have done against their dissidents.
Recall the U.N. definition of piracy as acts of “depredation [committed] for private ends.” Just as international piracy is viewed as transcending domestic criminal law, so too must the crime of international terrorism be defined as distinct from domestic homicide or, alternately, revolutionary activities. If a group directs its attacks on military or civilian targets within its own state, it may still fall within domestic criminal law. Yet once it directs those attacks on property or civilians belonging to another state, it exceeds both domestic law and the traditional right of self-determination, and becomes akin to a pirate band.

The real reason the detainees are not entitled to POW status is to be found in a distinction first made by the Romans and subsequently incorporated into international law by way of medieval European jurisprudence. As the eminent military historian, Sir Michael Howard, wrote in the October 2, 2001 edition of the Times of London, the Romans distinguished between bellum, war against legitimus hostis, a legitimate enemy, and guerra, war against latrunculi — pirates, robbers, brigands, and outlaws — “the common enemies of mankind.”
The present governments of Britain and the United States have vast military resources and enormously large cabinet departments filled with trained attorneys. It speaks eloquently of the decay of our educational system internationally that this fundamentally important aperçu needs to be advanced in the remoter reaches of the blogosphere five years after 9/11.
