Blackfive reports a recent hate crime incident in Chicago.
Jay R. Grodner, a Chicago attorney, was caught in the act of keying Marine Sgt. Mike McNulty’s automobile. Grodner was evidently provoked by McNulty’s Marine Corps license plate and decals.
After sending the car to the body shop, it was determined there is $2400 in damage, making this a felony. Mike went to court Friday morning to collect the damages against Mr. Grodner and file felony charges. Though the damages are over $300 (the amount which determines felony or misdemeanor) Grodner offered Mike to pay his deductible, $100, and have Mike’s insurance pay for it.
The Illinois States Attorneys tried to coerce Mike into accepting the offer. Appalled, Mike said he wanted this to be a felony. The state told Mike that it was not worth pursuing felony damage against Grodner because they don’t have the time. In addition, the state prosecutors told him that he would never it ‘would be difficult to recover the damages’ from Grodner because he is a lawyer.
Instead, the State asked Mike if he would accept probation for Grodner. Mike accepted, probation was offered to Grodner, and Grodner declined the offer, saying within ear shot of Mike, “I’m not going to make it easy on this kid”. Mike’s next court date is tomorrow, Monday, December 31st, to pursue misdemeanor charges against Grodner.
Mike’s leave is over on January 2nd when he reports to Camp Pendleton before heading to Iraq.
Jay Grodner knows this and is going to file for a continuance until Mike is gone and cannot appear in court.
This particular case is going to attract lots of attention. The MSM will be covering it in a day or two, and Mr. Grodner will be receiving a well-deserved 15 minutes of infamy. I predict he will soon be just as widely known as the District of Columbia judge who sued his Korean dry cleaner for $67 million dollars over a lost pair of trousers.

The New England town meeting has been long admired as a rare surviving instance of direct democracy in action, which gladdened the hearts of the democratic principle’s admirers everywhere by remaining practical and effective.
All that was, of course, in the old days, when town meetings were attended by crusty old farmers notorious for skepticism and common sense. Today, alas! Vermont towns have frequently been taken over by trust-fund bolsheviks and hippie tree-huggers, who bring a very different approach to direct democracy. Given access to direct democracy, these kinds of arriviste dingbats are moving to try to arrest the president and vice president.
Brattleboro Reformer:
We’re planning to arrest, detain and extradite him,” said Kurt Daims of Brattleboro, an activist who has sought to impeach President George W. Bush and is now trying to up the ante. “There’s a fundamental question here. If Congress doesn’t do this, shouldn’t it be done anyway?”
Daims hopes to gather the 440 signatures necessary to place an article on the Town Meeting warning that would call for the Brattleboro Police Department to arrest Bush and Vice President Dick Cheney and cart them off to unspecified foreign entities.
“Shall the Selectboard instruct the Town Attorney to draft indictments against President Bush and Vice President Cheney for crimes against our Constitution, and publish said indictment for consideration by other municipalities?” Daims’ proposed article reads.
“And shall it be the law of the Town of Brattleboro that the Brattleboro Police, pursuant to the above-mentioned indictment, arrest and detain George Bush and Richard Cheney in Brattleboro and extradite them to other authorities that may reasonably contend to prosecute them.”
Daims joined a group of eight like-minded activists Friday afternoon for their weekly impeachment march through town. Beating homemade drums and waving signs calling for the impeachment of Bush and Cheney, the protesters walked from the Brattleboro Food Co-op to the Municipal Building and dropped off a copy of the proposed article at the Town Clerk’s office.
According to Newfane Selectboard member Dan DeWalt, who made headlines when his town called for Bush’s impeachment in March of 2006, even if Daims is unsuccessful in throwing Bush in the clinker, his message could resonate throughout the country.
“Kurt saying ‘I’m going to arrest the president’ has no meaning. The town of Brattleboro voting to say they’re going to arrest the president does have meaning,” DeWalt said.
As to just where Brattleboro would send Bush if he was arrested, DeWalt said, “I know there are people preparing war crimes charges against him. I don’t know if they’ve officially been filed anywhere, but once they are filed that would give us a place to extradite him to next time he comes to town.”
Daims hopes other towns will be inspired by his quest and pursue similar courses of action — particularly Kennebunkport, Maine, where the Bush family spends its summers.
“We should do something Mr. Bush can feel. Maine is a very liberal state and I think this could pass in Maine, so then he couldn’t get to his million dollar family vacation resort,” Daims said. “They could arrest him there.”

Robert Maranto, associate professor of political science at Villanova University, reports, in the Washington Post, on the chasm separating the gauchist monoculture of the contemporary academical clerisy from the American political mainsteam.
At a Harvard symposium in October, former Harvard president and Clinton Treasury secretary Larry Summers argued that among liberal arts and social science professors at elite graduate universities, Republicans are “the third group,” far behind Democrats and even Ralph Nader supporters. Summers mused that in Washington he was “the right half of the left,” while at Harvard he found himself “on the right half of the right.”
I know how he feels. I spent four years in the 1990s working at the centrist Brookings Institution and for the Clinton administration and felt right at home ideologically. Yet during much of my two decades in academia, I’ve been on the “far right” as one who thinks that welfare reform helped the poor, that the United States was right to fight and win the Cold War, and that environmental regulations should be balanced against property rights.
All these views — commonplace in American society and among the political class — are practically verboten in much of academia. At many of the colleges I’ve taught at or consulted for, a perusal of the speakers list and the required readings in the campus bookstore convinced me that a student could probably go through four years without ever encountering a right-of-center view portrayed in a positive light.
A sociologist I know recalls that his decision to become a registered Republican caused “a sensation” at his university. “It was as if I had become a child molester,” he said. He eventually quit academia to join a think tank because “you don’t want to be in a department where everyone hates your guts.”
I think my political views hurt my career some years back when I was interviewing for a job at a prestigious research university. Everything seemed to be going well until I mentioned, in a casual conversation with department members over dinner, that I planned to vote Republican in the upcoming presidential election. Conversation came to a halt, and someone quickly changed the subject. The next day, I thought my final interview went fairly well. But the department ended up hiring someone who had published far less, but apparently “fit” better than I did. At least that’s what I was told when I called a month later to learn the outcome of the job search, having never received any further communication from the school. (A friend at the same university later told me he didn’t believe that particular department would ever hire a Republican.) …
Daniel Klein of George Mason University and Charlotta Stern of Stockholm University looked at all the reliable published studies of professors’ political and ideological attachments. They found that conservatives and libertarians are outnumbered by liberals and Marxists by roughly two to one in economics, more than five to one in political science, and by 20 to one or more in anthropology and sociology.
In a quantitative analysis of a large-scale student survey, Matthew Woessner of Penn State-Harrisburg and April Kelly-Woessner of Elizabethtown College found strong statistical evidence that talented conservative undergraduates in the humanities, social sciences and sciences are less likely to pursue a PhD than their liberal peers, in part for personal reasons, but also in part because they are offered fewer opportunities to do research with their professors. (Interestingly, this does not hold for highly applied areas such as nursing or computer science.)
Further, academic job markets seem to discriminate against socially conservative PhDs. Stanley Rothman of Smith College and S. Robert Lichter of George Mason University find strong statistical evidence that these academics must publish more books and articles to get the same jobs as their liberal peers. Among professors who have published a book, 73 percent of Democrats are in high-prestige colleges and universities, compared with only 56 percent of Republicans. …
I believe that for the most part the biases conservative academics face are subtle, even unintentional. When making hiring decisions and confronted with several good candidates, we college professors, like anyone else, tend to select people like ourselves.
Unfortunately, subtle biases in how conservative students and professors are treated in the classroom and in the job market have very unsubtle effects on the ideological makeup of the professoriate. The resulting lack of intellectual diversity harms academia by limiting the questions academics ask, the phenomena we study, and ultimately the conclusions we reach.

Greenpeace thinks it has found the way to defeat the clever Japanese, who manage to harvest hump-backed whales in defiance of an international ban on whaling… “for research.” After they’ve been “researched,” you see, Japan’s harvested whales are not simply discarded, but instead manage to find their way to Japanese dining tables.
This year Greenpeace (couch-Eco-warriors that they are) is following the humpback whales by satellite, and proposes to save them by asking its website’s bleating moonbat readers to select a name. Once they’ve named the puppy, the theory is that presumably it will be that much easier to guilt the Japanese about eating it.
And what a choice of names!

Jonah Goldberg, in the LA Times (now asking for registration), demolishes the leftwing fantasy of the American Empire.
Critics of American foreign policy point to the fact that the U.S. does many things that empires once did — police the seas, deploy militaries abroad, provide a lingua franca and a global currency — and then rest their case. But noting that X does many of the same things as Y does not mean that X and Y are the same thing. The police provide protection, and so does the Mafia. Orphanages raise children, but they aren’t parents. If your wife cleans your home, tell her she’s the maid because maids also clean homes. See how well that logic works.
When they speak of the American empire, critics fall back on cartoonish notions, invoking Hollywoodized versions of ancient Rome or mothballed Marxist caricatures of the British Raj. But unlike the Romans or even the British, our garrisons can be ejected without firing a shot. We left the Philippines when asked. We may split from South Korea in the next few years under similar circumstances. Poland wants our military bases; Germany is grumpy about losing them. When Turkey, a U.S. ally and member of NATO, refused to let American troops invade Iraq from its territory, the U.S. government said “fine.” We didn’t invade Iraq for oil (all we needed to do to buy it was lift the embargo), and we’ve made it clear that we’ll leave Iraq if the Iraqis ask.
The second verse of the anti-imperial lament, sung in unison by liberals and libertarians, goes like this: Expansion of the military-industrial complex leads to contraction of freedom at home. But historically, this is a hard sell. Women got the vote largely thanks to World War I. President Truman, that consummate Cold Warrior, integrated the Army, and the civil rights movement escalated its successes even as we escalated the Cold War and our presence in Vietnam. President Reagan built up the military even as he liberalized the economy.
Sure Naomi Wolfe, Frank Rich and other leftists believe that the imperialistic war on terror has turned America into a police state. But if they were right, they wouldn’t be allowed to say that.

Fifty years ago, New American Library published the Mentor Philosophers series, each with a title beginning The Age of . . . Belief, Ideology, Reason, and so on; the 20th-century selections bore the title The Age of Analysis. Had the series continued to the end of that century and into this, the volume should no doubt be The Age of Apology. Our postmodern ethos seems to hold that if anything can be proved to have happened, then surely someone needs to apologize for it.
We live amid a veritable tsunami of apology. The Catholic Church, which, of course, has much to apologize for, has, of late, offered mea culpas to Galileo, the Jews, the gypsies, Jan Hus, whom it burned at the stake in 1415, even to Constantinople (now Istanbul) for its sacking 800 years ago by the knights of the Fourth Crusade, an event for which the late John Paul II expressed “deep regret.†No wonder that a group in England, claiming descent from the medieval Knights Templars, is asking the Vatican to apologize for the violent suppression of the order and for torturing to death its Grand Master Jacques de Molay in 1314, an apology timed to commemorate the 700th anniversary of that fell deed. In America, the National Council of Churches apologized to Native Americans for Europeans’ discovering their continent and appropriating their land (but did not return any church’s specific holdings to any specific tribe). The United Church of Canada followed suit, officially apologizing to Canada’s native peoples for wrongs inflicted by the church; the native peoples, however, officially rejected the apology.
The current lieutenant governor of Illinois, Pat Quinn, personally presented the leaders of the Mormon church with a copy of his state legislature’s House Resolution 793, expressing “official regret†for the 1844 murder of Joseph Smith and the expulsion of his followers, the Church of Jesus Christ of Latter-day Saints. The language asking for “pardon and forgiveness†was toned down when certain lawmakers protested that they could not ask for forgiveness for acts that they had not personally committed — a retrograde notion, apparently, of individual responsibility. Tony Blair, as British prime minister, apologized to the Irish for his nation’s insensitivity to the plight of the victims of the Potato Famine in the 1840s. A hundred years after the event, the U.S. Congress offered a formal apology to the Hawaiians for the overthrow of their monarchy in 1893. The French parlement unanimously adopted a law stating that “the trans-Atlantic and Indian Ocean slave trade, perpetuated from the 15th century against Africans, Amerindians, Malagasies and Indians, constitutes a crime against humanityâ€: the centuries of slavery before the 15th and the slavery of other peoples do not, apparently, constitute such a crime, at least in France.
In 2005 the U.S. Senate formally apologized for something that it had not done: make lynching a federal crime. Such a record of inaction, claimed one of the resolution’s sponsors, constituted a “stain on the United States Senate.†True enough, no doubt, but one of how many? Imagine if the United States or any other government began apologizing not only for sins of commission but for those of omission: an infinite regress of culpability.
My favorite apology so far, however, appeared in a brief Reuters account. “Villagers of the tiny settlement of Nubutautau [Fiji] wept as they apologized to the descendants of a British missionary killed and eaten by their ancestors 136 years ago,†the news agency reported. “The villagers and the relatives of the missionary, the Rev. Thomas Baker, were taking part in a complex ritual intended to lift a curse the locals say has caused an extended run of bad luck.†A cow was slaughtered and kisses given to the 11 relatives of the missionary by the village chief, Ratu Filimoni Nawawabalavu, “a descendant of the chief who cooked the missionary.†No word on whether the curse lifted. …
Our mania for apology stems from a radical sort of “presentismâ€: the belief, in practice, if not fully articulated, that the actions and actors of the past should be evaluated, and usually condemned, by present-day standards. In our relativistic age in which advanced opinion notoriously eschews universals and absolutes, the criteria obtaining at the moment in Cambridge and Chapel Hill, Ann Arbor and Palo Alto, Austin and Madison seem to have more than contingent status. The criteria appear perilously close to absolutes, the sort of absolutes obeisance to which allows moderately competent graduate students in sociology or culture studies to relish their moral superiority to almost any denizen of the benighted pre-Foucault past. One has only to listen to the incredulous-to-hostile laughter that, at academic conferences, greets the opinions of, say, Henry Adams or Thomas Carlyle on the mental capacities of women, or of Hegel or Hume on Africans, commonplace a century or two ago, to understand how relative our relativism really is.
Presentism wants not only to judge the past by the criteria of the present, but, in a complete failure of historical imagination, can’t conceive of the criteria of the future being radically different from today’s.

Dennis Praeger explains the fundamental, underlying dynamic:
One of the most widely held beliefs in the contemporary world — so widely held it is not disputed — is that, with few exceptions, the world hates America. One of the Democrats’ major accusations against the Bush administration is that it has increased hatred of America to unprecedented levels. And in many polls, the United States is held to be among the greatest obstacles to world peace and harmony.
But it is not true that the world hates America. It is the world’s left that hates America. However, because the left dominates the world’s news media and because most people, understandably, believe what the news media report, many people, including Americans, believe that the world hates America.

With characteristic intellectual dishonesty, leftist Jane Hamsher (along with the rest of the Left Blogosphere) is accusing T. Boone Pickens of reneging on a pledge made November 6th at the American Spectator 40th Anniversary Dinner.
RedState.com reports Pickens to have offered to bet $1 million that John Kerry could not prove “anything the Swift Boat Veterans For Truth said in 2004 was false.”
Clarice Feldman, at American Thinker, in reporting on the events of the evening, also wrote:
T. Boone Pickens responded to John F. Kerry’s latest whining about his having been “swiftboated” by offering a million dollars to anyone who could prove wrong anything the Swiftboat Veterans charged about Kerry.
Pickens offered a $1 million bet that any of the Swift Boat Veterans For Truth’s charges cannot be disproved by John Kerry. Now, John Kerry, and his friends on the Left generally, want to collect that million dollars and claim vindication for John Kerry, if Kerry can simply make his own choice of any single proposition, and deliver a persuasive counterargument.
All arguments with the American Left descend quickly to the school yard level, don’t they?
I remember the 2004 election very well. John Kerry, in what seemed like a bizarre choice, chose to try running for president as a war hero. Since John Kerry’s political career was founded on his leftwing antiwar activities, and since he had already been an opponent of the War in Vietnam at Yale (before he enlisted in the Navy in order to avoid being drafted), there was more than a little incongruity in Kerry’s attempting to combine two completely incompatible stances.
The Swift Boat Veterans For Truth did devastating injury to Kerry’s claims to military glory with a book and a series of political ads. If John Kerry was really in a position to refute their charges, the time for him to have done so was really back during the Campaign of 2004 when the presidency was at stake.
Once the election was concluded, Kerry and his allies in the establishment media began trying to turn the tables, making “swiftboating” into a term of abuse, and depicting John Kerry as some sort of injured innocent.
Long after the votes had been counted, in June of 2005, Kerry released (some? all?) of his Navy Records only to the Boston Globe, a reliably liberal and democrat paper. The Globe dutifully obfuscated by carefully overlooking any and all of the controversial aspects of Kerry’s military record and producing a distracting and meaningless exposé of Kerry’s grades at Yale.
According to Kerry’s supporters in the MSM, that release of records to the Globe “definitively proved the baselessness of smears by the anti-Kerry group Swift Boat Veterans for Truth.”
In 2005, a group of unpublished and unreported records released to a single partisan newspaper supposedly sufficed to refute all the charges against John Kerry.
Now, in November of 2007, according to the Left, all John Kerry needs to do is to go carefully through John E. O’Neill’s Unfit for Command and the Swift Boat Veterans’ ads with a fine-toothed comb to find one single contention, one individual detail, one specific item in a very long bill of charges which he can decisively refute, and voilá! Kerry wins, Pickens and the Swifties lose.
Sorry, lefties, a million dollars is a serious amount of money, and the issues at stake here are serious issues, Kerry and the Left cannot really hope to win this one by a clever little last-tag children’s-game maneuver, or by skillful lawyering, or by the grace and favor of the MSM.

1) The journal you maintained during your service in Vietnam.

As you know, I have been a long and proud supporter of the American military and veterans’ causes. Sounds fair to me.
I’d say John Kerry has made another mistake in trying to play this game. And all the nonsense the left Blogosphere can post will not save him. If Kerry thinks he can refute the Swift Boat Veterans’ charges, he is going to have to release his personal and official records, to the entire press corps, not just to a pet hometown paper. If he refuses to do so, he may not have to pay $1 million, but he will clearly have lost this particular bet.

Slavoj Žižek, in the London Review of Books, contemplates the peculiar position of today’s Left after the collapse of Communism.
One of the clearest lessons of the last few decades is that capitalism is indestructible. Marx compared it to a vampire, and one of the salient points of comparison now appears to be that vampires always rise up again after being stabbed to death. Even Mao’s attempt, in the Cultural Revolution, to wipe out the traces of capitalism, ended up in its triumphant return.
Today’s Left reacts in a wide variety of ways to the hegemony of global capitalism and its political supplement, liberal democracy. …
The response of some critics on the postmodern Left to this predicament is to call for a new politics of resistance. Those who still insist on fighting state power, let alone seizing it, are accused of remaining stuck within the ‘old paradigm’: the task today, their critics say, is to resist state power by withdrawing from its terrain and creating new spaces outside its control. This is, of course, the obverse of accepting the triumph of capitalism. The politics of resistance is nothing but the moralising supplement to a Third Way Left.
Simon Critchley’s recent book, Infinitely Demanding, is an almost perfect embodiment of this position. For Critchley, the liberal-democratic state is here to stay. Attempts to abolish the state failed miserably; consequently, the new politics has to be located at a distance from it: anti-war movements, ecological organisations, groups protesting against racist or sexist abuses, and other forms of local self-organisation. It must be a politics of resistance to the state, of bombarding the state with impossible demands, of denouncing the limitations of state mechanisms. The main argument for conducting the politics of resistance at a distance from the state hinges on the ethical dimension of the ‘infinitely demanding’ call for justice: no state can heed this call, since its ultimate goal is the ‘real-political’ one of ensuring its own reproduction (its economic growth, public safety, etc). ‘Of course,’ Critchley writes,
history is habitually written by the people with the guns and sticks and one cannot expect to defeat them with mocking satire and feather dusters. Yet, as the history of ultra-leftist active nihilism eloquently shows, one is lost the moment one picks up the guns and sticks. Anarchic political resistance should not seek to mimic and mirror the archic violent sovereignty it opposes.
So what should, say, the US Democrats do? Stop competing for state power and withdraw to the interstices of the state, leaving state power to the Republicans and start a campaign of anarchic resistance to it? And what would Critchley do if he were facing an adversary like Hitler? Surely in such a case one should ‘mimic and mirror the archic violent sovereignty’ one opposes? Shouldn’t the Left draw a distinction between the circumstances in which one would resort to violence in confronting the state, and those in which all one can and should do is use ‘mocking satire and feather dusters’? The ambiguity of Critchley’s position resides in a strange non sequitur: if the state is here to stay, if it is impossible to abolish it (or capitalism), why retreat from it? Why not act with(in) the state? Why not accept the basic premise of the Third Way? Why limit oneself to a politics which, as Critchley puts it, ‘calls the state into question and calls the established order to account, not in order to do away with the state, desirable though that might well be in some utopian sense, but in order to better it or attenuate its malicious effect’?
These words simply demonstrate that today’s liberal-democratic state and the dream of an ‘infinitely demanding’ anarchic politics exist in a relationship of mutual parasitism: anarchic agents do the ethical thinking, and the state does the work of running and regulating society. Critchley’s anarchic ethico-political agent acts like a superego, comfortably bombarding the state with demands; and the more the state tries to satisfy these demands, the more guilty it is seen to be. In compliance with this logic, the anarchic agents focus their protest not on open dictatorships, but on the hypocrisy of liberal democracies, who are accused of betraying their own professed principles. …
The big demonstrations in London and Washington against the US attack on Iraq a few years ago offer an exemplary case of this strange symbiotic relationship between power and resistance. Their paradoxical outcome was that both sides were satisfied. The protesters saved their beautiful souls: they made it clear that they don’t agree with the government’s policy on Iraq. Those in power calmly accepted it, even profited from it: not only did the protests in no way prevent the already-made decision to attack Iraq; they also served to legitimise it. Thus George Bush’s reaction to mass demonstrations protesting his visit to London, in effect: ‘You see, this is what we are fighting for, so that what people are doing here – protesting against their government policy – will be possible also in Iraq!’
The lesson here is that the truly subversive thing is not to insist on ‘infinite’ demands we know those in power cannot fulfill. Since they know that we know it, such an ‘infinitely demanding’ attitude presents no problem for those in power: ‘So wonderful that, with your critical demands, you remind us what kind of world we would all like to live in. Unfortunately, we live in the real world, where we have to make do with what is possible.’ The thing to do is, on the contrary, to bombard those in power with strategically well-selected, precise, finite demands, which can’t be met with the same excuse.

Peter Berkowitz, in the Wall Street Journal, describes a personal encounter with the hydrophobic Bush-hatred infecting America’s chattering classes.
This distinguishing feature of Bush hatred was brought home to me on a recent visit to Princeton University. I had been invited to appear on a panel to debate the ideas in Princeton professor and American Prospect editor Paul Starr’s excellent new book, “Freedom’s Power: The True Force of Liberalism.” To put in context Prof. Starr’s grounding of contemporary progressivism in the larger liberal tradition, I recounted to the Princeton audience an exchange at a dinner I hosted in Washington in June 2004 for several distinguished progressive scholars, journalists, and policy analysts.
To get the conversation rolling at that D.C. dinner–and perhaps mischievously–I wondered aloud whether Bush hatred had not made rational discussion of politics in Washington all but impossible. One guest responded in a loud, seething, in-your-face voice, “What’s irrational about hating George W. Bush?” His vehemence caused his fellow progressives to gather around and lean in, like kids on a playground who see a fight brewing.
Reluctant to see the dinner fall apart before drinks had been served, I sought to ease the tension. I said, gently, that I rarely found hatred a rational force in politics, but, who knows, perhaps this was a special case. And then I tried to change the subject.
But my dinner companion wouldn’t allow it. “No,” he said, angrily. “You started it. You make the case that it’s not rational to hate Bush.” I looked around the table for help. Instead, I found faces keen for my response. So, for several minutes, I held forth, suggesting that however wrongheaded or harmful to the national interest the president’s policies may have seemed to my progressive colleagues, hatred tended to cloud judgment, and therefore was a passion that a citizen should not be proud of being in the grips of and should avoid bringing to public debate. Propositions, one might have thought, that would not be controversial among intellectuals devoted to thinking and writing about politics.
But controversial they were. Finally, another guest, a man I had long admired, an incisive thinker and a political moderate, cleared his throat, and asked if he could interject. I welcomed his intervention, confident that he would ease the tension by lending his authority in support of the sole claim that I was defending, namely, that Bush hatred subverted sound thinking. He cleared his throat for a second time. Then, with all eyes on him, and measuring every word, he proclaimed, “I . . . hate . . . the . . . way . . . Bush . . . talks.”

J.R. Dunn, at American Thinker, discusses the Left’s successful propaganda campaign on so-called “Torture.” The Left controls the narrative in matters of this kind by using a combination of its domination of the MSM and emotionalism to shout down dissent.
Torture” is one of many current topics of significance that have been abandoned to the left. Leftist commentators have been allowed to set the terms, make the definitions, and generally run the argument without much in the way of serious opposition or debate.
No small number of elements of the War on Terror have suffered the same treatment. An offhand list would include profiling, wiretapping, border security, and rendition. All have been hijacked and turned into battering rams to support a particular left-wing interpretation of the War on Terror. The GOP has been unable to respond for a number of reasons: they’ve been blindsided, have been busy fending off corruption investigations, or simply couldn’t or wouldn’t defend certain obvious positions. As a result, the left has been able to peddle its version of events with near impunity.
“Torture” is probably the most egregious of these cases. That’s the explanation for the sneer quotes. Because, quite simply, in much of the debate over “torture”, we’re not talking about actual torture at all. We’re talking about rough treatment, harshness, or coercion.
The American left has defined these upward until they mean the same thing as torture, all as a part of their efforts to undermine the War on Terror in general. The core of this stance is the assertion that a slap on the head, several days without sleep, or hearing Rage Against the Machine played at full volume is fully the equivalent of torture in the classic sense. (Well… maybe we should reconsider that last….)
Of course, it’s no such thing. Torture is easily defined as physical assault carried out over a prolonged period against a victim under complete control and holding the possibility of permanent physical or psychic damage. Official legal terminology contains the proviso that torture consists of acts that “revolt the conscience” We can also add, by way of Dashiell Hammett, that such actions must have “threat of death behind them”. If they contain these elements, they are torture. If not, they’re something less. Not necessarily something justifiable or commendable, but not torture either. (Another method of judging these actions is to ask whether the activity would excite an individual like Mengele or Yezhov.)
The left has succeeded, through a relentless media campaign (is there any other kind?) in obscuring this distinction. According to the latest criteria, torture is anything unpleasant that occurs to a prisoner while in American custody. (Overseas it’s different. It’s very, very difficult — almost impossible, in fact — for any developing or left-of-center regime to commit torture, no matter what they do to their prisoners. Unless, as in the rendition uproar, the U.S. is somehow involved.)
