Freedom of Speech at Harvard

Last year, a third-year Harvard Law Student sent a private email to two friends, continuing a dinner-table conversation about the genetic basis of (and possible racial differences in) intelligence.

She said:

I absolutely do not rule out the possibility that African Americans are, on average, genetically predisposed to be less intelligent. I could also obviously be convinced that by controlling for the right variables, we would see that they are, in fact, as intelligent as white people under the same circumstances. The fact is, some things are genetic. African Americans tend to have darker skin. Irish people are more likely to have red hair. (Now on to the more controversial:) Women tend to perform less well in math due at least in part to prenatal levels of testosterone, which also account for variations in mathematics performance within genders. This suggests to me that some part of intelligence is genetic, just like identical twins raised apart tend to have very similar IQs and just like I think my babies will be geniuses and beautiful individuals whether I raise them or give them to an orphanage in Nigeria. I don’t think it is that controversial of an opinion to say I think it is at least possible that African Americans are less intelligent on a genetic level, and I didn’t mean to shy away from that opinion at dinner.

I also don’t think that there are no cultural differences or that cultural differences are not likely the most important sources of disparate test scores (statistically, the measurable ones like income do account for some raw differences). I would just like some scientific data to disprove the genetic position, and it is often hard given difficult to quantify cultural aspects.

This young woman ought to have gotten away scot-free with saying the unsayable and thinking the unthinkable in private, but more recently she reproached one of those two friends about sleeping with another person’s boyfriend. Her interlocutor promised “to ruin her life,” and proceeded on a program of revenge worthy of the Jacobean Theater.

The vengeful strumpet forwarded the six-month-old email to members of the Harvard Black Law Student Association, who were definitely not amused.

Someone then passed it along to the legal blog Above the Law. Gawker and HuffPo picked up the story, and soon it was everywhere.

Before very long, the Dean of Harvard Law School, Martha Minow was issuing official statements assuring Black law students that “Here at Harvard Law School, we are committed to preventing degradation of any individual or group, including race-based insensitivity or hostility.”

The PC-criminal, an editor at the Harvard Law Review, had already received a clerkship with colorful Ninth Circuit Judge Alex Kozinski. Indignant demands that her clerkship should be rescinded followed.

But they teach young people well at today’s elite schools. When you blot your copybook, it is still possible to save yourself by performing the appropriate prostrations and affirming loudly that the sun does move around the earth. Look at Bill Clinton.

Our guilty student did the necessary thing, she wrote a thoroughly PC letter of apology, and took complete responsibility. (laugh)

Boston Globe:

“I am deeply sorry for the pain caused by my e-mail. I never intended to cause any harm, and I am heartbroken and devastated by the harm that has ensued. I would give anything to take it back,’’ [Name withheld by me] said in the apology, obtained by the Globe.

“I emphatically do not believe that African-Americans are genetically inferior in any way. I understand why my words expressing even a doubt in that regard were and are offensive.’’ …

In her statement yesterday, Minow called the incident “sad and unfortunate’’ but said she was heartened by the student’s apology. She added: “We seek to encourage freedom of expression, but freedom of speech should be accompanied by responsibility.’’

The Arizona Emergency

Yesterday, our friend Bird Dog at Maggie’s Farm linked the generally admirable Clarice Feldman at American Thinker who was editorializing from the perspective opposite to my own on immigration.

Ms. Feldman quoted some alarming, and authoritative sounding, statistics from “the Law Enforcement Examiner.”

On April 7, 2007, the US Justice Department issued a report on criminal aliens that were incarcerated in federal and state prisons and local jails.

In the population study of 55,322 illegal aliens, researchers found that they were arrested at least a total of 459,614 times, averaging about 8 arrests per illegal alien. Nearly all had more than 1 arrest. Thirty-eight percent (about 21,000) had between 2 and 5 arrests, 32 percent (about 18,000) had between 6 and 10 arrests, and 26 percent (about 15,000) had 11 or more arrests. Most of the arrests occurred after 1990.

They were arrested for a total of about 700,000 criminal offenses, averaging about 13 offenses per illegal alien. One arrest incident may include multiple offenses, a fact that explains why there are nearly one and half times more offenses than arrests. Almost all of these illegal aliens were arrested for more than 1 offense. Slightly more than half of the 55,322 illegal aliens had between 2 and 10 offenses.

More than two-thirds of the defendants charged with an immigration offense were identified as having been previously arrested. Thirty-six percent had been arrested on at least 5 prior occasions; 22%, 2 to 4 times; and 12%,1 time.

Clarice Feldman ought to have inquired a little more more closely.

“The Law Enforcement Examiner” is actually an editorialist named Jim Kouri. Mr. Kouri’s biography identifies him as a former chief security guard at a housing project in Washington Heights and the “fifth vice-president of the National Association of Chiefs of Police” which, I expect, must be roughly on a par with being First Guard of the Tent at one’s local International Order of Oddfellows chapter.

Mr. Kouri is renowned on the Internet for his expertise on Satanism and for the exoticism of the views of some sources he has in the past relied upon.

Unfortunately, Mr. Kouri is not himself a reliable source. He tells us that his statistics come from “a report on criminal aliens that were incarcerated in federal and state prisons and local jails” issued by the US Justice Department on April 7, 2007.

It is not accidental that Mr. Kouri does not link the original report.

The report in question was really released on May 9, 2005. It is GAO report number GAO-05-646R entitled ‘Information on Certain Illegal Aliens Arrested in the United States.’

The figures cited all pertain to 2002-2003. Mr. Kouri (and the study’s authors) deliberately selected the best figures for making certain kinds of arguments in the quoted paragraphs.

In reality, this study pertains to 55,322 individual illegal aliens who are the portion of the illegal alien population that wound up arrested, convicted, and sentenced to jail.

55,322 out of the seven million illegal aliens estimated to be present in the United States by this same study is the 0.0079 portion of that illegal immigrant population, well under 1%.

And the character of their crimes?

Forty-five percent of illegal alien offenses were for drugs and immigration;

8% for Traffic violations;

7% for Obstruction of Justice.

60% of the under 1% of illegals in jail in 2002-2003 were not even in jail for any form of theft or violence.

And, more recently, both illegal immigration and violent crime have actually been declining (even while la patrie est en danger reports are dramatically increasing).

CNN:

[S]tatistics from the U.S. Customs and Border Protection agency and the FBI indicate that both the number of illegal crossers and violent crime in general have actually decreased in the past several years.

According to FBI statistics, violent crimes reported in Arizona dropped by nearly 1,500 reported incidents between 2005 and 2008. Reported property crimes also fell, from about 287,000 reported incidents to 279,000 in the same period. These decreases are accentuated by the fact that Arizona’s population grew by 600,000 between 2005 and 2008.

According to the nonpartisan Immigration Policy Institute, proponents of the bill “overlook two salient points: Crime rates have already been falling in Arizona for years despite the presence of unauthorized immigrants, and a century’s worth of research has demonstrated that immigrants are less likely to commit crimes or be behind bars than the native-born.”

If we really looked at the facts, we could only conclude that illegal immigration is not the same thing as narcotics smuggling and, by and large, illegal immigrants tend to be more law-abiding and less violent than us native-born Americans. The public panic and the draconian laws represent responses to misinformation, commonly disseminated by sensationalizing journalists.

Look at AP and Matt Drudge yesterday. or check today’s Wall Street Journal, which blares Killing Stokes Immigration Debate, in reference to Deputy Puroll getting slightly grazed in a minor skirmish with marijuana smugglers. Nobody got killed, and the incident had nothing to with illegal immigration.

Blagojevich Trial May Include Obama

An unnamed public official

Mark Brown, at the Chicago Sun-Times, is very amused by the determined efforts of the District Judge to keep a certain unnamed public official from having to testify in the trial of Rod Blagojevich

[A] three-paragraph letter that they say was turned over to the defense by prosecutors during a recent closed-door session in the governor’s chambers, laying out new information that convicted political insider Tony Rezko allegedly has told investigators, particularly this: that Rezko said he “believed he transmitted a quid pro quo offer from a lobbyist to the public official, whereby the lobbyist would hold fund-raiser for the official in exchange for favorable official action, but that the public official rejected the offer.”

It also said the public official “denies any such conversation.”

Without flat-out naming Obama as that public official, the governor’s lawyers did everything but draw us a picture, saying Obama “is the only one who can testify as to the veracity” of Rezko’s allegations.

In other words, they’re saying Rezko reported trying to bribe Obama, and that while Rezko said Obama turned him down, Obama said it never happened.

Even if the prosecution avoids using testimony from Antoin Rezko in order to avoid deposing that particular unnamed public official, the Blagojevich defense may yet succeed in dragging Obama into the mess to testify about his own role in the negotiations over Blagojevich’s appointment of a successor to Obama’s seat in the Senate.

According to Blagojevich:

On the day before he was elected president, then-Sen. Obama personally called a union official about his desire for Blagojevich to appoint Obama adviser Valerie Jarrett to replace him in the Senate, according to Blagojevich’s defense filing in U.S. District Court in Chicago.

Preacher Arrested in Britain for Calling Homosexuality a Sin

A Baptist street preacher was arrested in Wokington, Cumbria by a police force lesbian, gay, bisexual and transgender liaison officer for the crime of stating aloud in public that homosexual acts are sinful.

If anyone wonders why many Americans are not eager to follow the political examples set by European countries in all things, I would recommend this story as a good example of policies not worth following.

Telegraph:

Dale McAlpine was charged with causing “harassment, alarm or distress” after a homosexual police community support officer (PCSO) overheard him reciting a number of “sins” referred to in the Bible, including blasphemy, drunkenness and same sex relationships.

The 42-year-old Baptist, who has preached Christianity in Wokington, Cumbria for years, said he did not mention homosexuality while delivering a sermon from the top of a stepladder, but admitted telling a passing shopper that he believed it went against the word of God.

Police officers are alleging that he made the remark in a voice loud enough to be overheard by others and have charged him with using abusive or insulting language, contrary to the Public Order Act.

Mr McAlpine, who was taken to the police station in the back of a marked van and locked in a cell for seven hours on April 20, said the incident was among the worst experiences of his life.

Household Cavalry Marksman Claims New Sniping Record

Last November, while escorting an Afghan Infantry unit, CoH Harrison’s troop commander’s Jackal fighting vehicle came under fire from insurgents armed with a PKM. From further back on the ridge, CoH Harrison rested the bipod of his .338 Lapua Magnum L115A3 on a compound wall, and shot both jihadis dead at 1.54 miles, establishing a new military sniper’s record.

London Times:

A British Army sniper has set a new sharpshooting distance record by killing two Taliban machinegunners in Afghanistan from more than 1 miles away.

Craig Harrison, a member of the Household Cavalry, killed the insurgents with consecutive shots — even though they were 3,000ft beyond the most effective range of his rifle.

“The first round hit a machinegunner in the stomach and killed him outright,” said Harrison, a Corporal of Horse. “He went straight down and didn’t move.

“The second insurgent grabbed the weapon and turned as my second shot hit him in the side. He went down, too. They were both dead.”

The shooting — which took place while Harrison’s colleagues came under attack — was at such extreme range that the 8.59mm (.338 Lapua Magnum — DZ) bullets took almost three seconds to reach their target after leaving the barrel of the rifle at almost three times the speed of sound.

The distance to Harrison’s two targets was measured by a GPS system at 8,120ft, or 1.54 miles. The previous record for a sniper kill is 7,972ft, set by a Canadian soldier who shot dead an Al-Qaeda gunman in March 2002. …

Harrison and his colleagues were in open-topped Jackal 4×4 vehicles providing cover for an Afghan national army patrol south of Musa Qala in November last year. When the Afghan soldiers and Harrison’s troop commander came under enemy fire, the sniper, whose vehicle was further back on a ridge, trained his sights on a Taliban compound in the distance. His L115A3 long-range rifle, the army’s most powerful sniper weapon, is designed to be effective at up to 4,921ft and supposedly capable of only “harassing fire” beyond that range.

“We saw two insurgents running through its courtyard, one in a black dishdasha, one in green,” he said. “They came forward carrying a PKM machinegun, set it up and opened fire on the commander’s wagon.

“Conditions were perfect, no wind, mild weather, clear visibility. I rested the bipod of my weapon on a compound wall and aimed for the gunner firing the machinegun.

“The driver of my Jackal, Trooper Cliff O’Farrell, spotted for me, providing all the information needed for the shot, which was at the extreme range of the weapon.”

Harrison killed one machinegunner with his first attempt and felled the other with his next shot. He then let off a final round to knock the enemy weapon out of action.

Harrison discovered that he had set a new record only on his return to UK barracks nine days ago. The previous record was held by Corporal Rob Furlong, of Princess Patricia’s Canadian Light Infantry, who was using a 12.7mm (otherwise known as the .50 BMG — DZ) McMillan TAC-50 rifle.

Witness Reports: Ayers Family Assisted Obama’s Education

Santa Clara Law School Professor Steve Diamond, who is no conservative, seems to have found a witness able to establish a relationship between Barack Obama and William Ayers going back to the mid-1980s.

Barack Obama visited the house of Tom and Mary Ayers, parents of former Weather Underground activist turned education professor Bill Ayers, in the mid-1980s to thank the Ayers’ for their support of his education, according to Allen Hulton, the letter carrier who delivered mail to the Ayers’ Glen Ellyn home at that time. Glen Ellyn is a suburb of Chicago, southwest of the city. …

At the time of their encounter, Hulton recalls, Obama “looked about 19 years old” but was probably in his early 20s. Obama graduated from Columbia University in 1983 and moved to Chicago in 1985 at age 24 or 25 to head up the DCP, a fledgling community organization modeled after similar groups started by Saul Alinsky, on the south side of Chicago. The DCP had secured a grant from the Woods Fund, endowed by the Woods family, to finance the hiring of Obama.

The Woods family owned Sahara Coal Company, which supplied coal to utility companies in the Midwest possibly including Commonwealth Edison. Tom Ayers was Chairman and CEO of Commonwealth Edison from 1973 until 1980. Ayers died in June of 2007 at the age of 92 in Hyde Park where he had been living with his son Bill and Dohrn.

“Mrs. Ayers told me that her family had been helping out a brilliant young black man,” Hulton said and whom he believes she said was from Kenya. Hulton said that over the period of six to ten years that he delivered mail to the Ayers home he had numerous conversations with Mrs. Ayers, one conversation with Thomas Ayers and several brief encounters with Bernardine Dohrn who he said lived at the home for several months at one point in time. He never met or saw Bill Ayers at the home. …

One day Hulton found himself on the sidewalk outside the Ayers home at 199 N. Montclair Avenue near the corner of Revere Road just after he had delivered the mail. The house was “very nice and attractive and more expensive than some in Glen Ellyn because it was closer to downtown, but it did not stand out among the houses on that block.” He said the largest and most expensive homes were actually on Revere, around the corner from the Ayers’ home.

As Hulton was on the sidewalk walking away from the Ayers house a tall and thin young black man was coming up the same sidewalk towards the Ayers house.

Hulton recalls that Obama said hello and introduced himself and stopped to chat with him in front of the Ayers house. “I recall that his ears stuck out a little bit. He was more gaunt then than he appears now. His name was an unusual one and when I saw his photo during the campaign it brought back my memory of the event,” Hulton said.

Mr. Obama explained that he had taken the train out from Chicago to visit the Ayers’ in order to thank them for their help with his “education.” At this time, Mr. Obama had recently graduated from Columbia and would soon enter Harvard Law School. Hulton and Obama “spoke for a few minutes, first chatting about the Ayers family,” Hulton said. Hulton said he did not learn whether the help Obama received from the Ayers’ was financial or in some other form. …

Mr. Hulton recalls that he probably asked what Mr. Obama was studying in school and at one point Mr. Obama said that he intended to become President of the United States. Mr. Hulton said he was “taken aback” by the statement but recalls that he did not think Mr. Obama was “arrogant, but just self assured and a person with a lot of self confidence.” “It was not said with hubris,” Hulton recalled, “but with an air of self-assuredness.”

“I told him there was no reason why he couldn’t become president,” Hulton recalled. Obama was dressed “nicely but casually, a slacks and shirt, not jeans and a t-shirt, but definitely not a coat or tie,” he said. After the brief conversation Hulton continued on his route and did not turn back to see whether the Ayers’ were at home or whether Obama entered their house.

How Do We Get Bad Laws?

Bad reporting using sensationalistic headlines incorporating gross exaggeration and downright misinformation is how.

Look at how various news sources headline a basically trivial injury to a law enforcement officer received in the course of a minor skirmish with drug smugglers near the border.

What actually happened:

Pinal County Deputy Louis Puroll patrolling alone in a wilderness area about 50 miles south of Phoenix exchanged fire with five armed smugglers carrying bales of marijuana. A shot fired from one of the narcotrafficantes’ AK-47s apparently grazed Deputy
Puroll’s back. He called for assistance and was airlifted by helicopter to a regional medical center where his injury was treated, deemed to be non-serious, and the deputy immediately released.

So the Associated Press shrieks:

Deputy shot; illegal immigrants suspected

AZ deputy shot in stomach by suspected illegal…

ABC15:

Deputy shot by suspected immigrant released from hospital

There isn’t really much to report here. A deputy was slightly grazed by a bullet, sustaining insignificant injury, in a minor confrontation with bad guys engaged in smuggling marijuana.

The incident really has nothing to do with illegal immigration. The marijuana smugglers were not, in reality, on their way to pick fruit, wash dishes, mow lawns, or hang sheetrock at all. They were delivering a shipment of pot and once they delivered it, doubtless they were going to illegally emigrate the same way they had illegally immigrated. Undocumented aliens are not in fact arming themselves with AK-47s and shooting it out with police in order to get their hands on American leaf blowers.

It’s unfortunate, of course, that Deputy Puroll was shot at and slightly injured. This incident causes me to marvel at the futility of it all. You’ve smoked pot. I’ve smoked pot. Pretty much everybody in America has smoked some pot. Certainly every single one of the last three presidents has smoked pot.

Why do we insist of making things illegal which most of us still do anyway? And why do we tolerate a state of affairs that rewards crime bounteously while jeopardizing the lives of law enforcement officers to no useful purpose?

And finally, why do we insist on confusing the innocent people coming here to do hard work at low pay with the armed criminals crossing the same border?

Studies show that illegal immigrants commit violent crimes at a rate between four to eight times less than native born Americans.

National Enquirer Claims Proof Obama is Straight

The National Enquirer cannot write grammatically, but it has been correct before about the scandalous love lives of prominent democrats (like John Edwards), so its contention that Barack Obama at some unspecified date spent the night at Washington, D.C.’s Hotel George with his 2004 Senate campaign Finance Director may possibly be true.

I don’t understand why the president would be staying at a Washington hotel overnight. He does actually have a residence elsewhere in that city. But the Hotel George is trendy and advertises itself as an eco-friendly, “green” boutique hotel with “a progressive approach to the well-being of our guests and planet” and is certainly just the kind of place Barack Obama would patronize.

Proof of a hot black mistress must be a little disappointing, I expect, to anyone who bought in to the gay sex and drugs rumors that swirled around Barack Obama during the 2008 Presidential Campaign. (Those rumors came from a petty criminal named Larry Sinclair who was anything but a credible source.)
